论代孕中的亲子关系——以全国首例非法代孕监护权纠纷案为例

【摘要】：应区别对待代孕协议中的监护权转移条款和其他条款,前者因违背法律的强制性规定而无效,后者要依据合同的一般生效要件而区分处理,如有偿代孕协议因违反社会公共利益原则而无效,而无偿的完全代孕并不当然无效。因此不能依据代孕协议确定代孕子女的法定父母,而应认定子宫提供者即受托人作为代孕子女法律上的母亲。委托人在符合《收养法》的前提下,经过受托人同意,可以收养代孕子女,与之建立父母子女关系。
[Abstract]:A distinction should be made between the transfer of custody clause in the surrogate agreement and the other provisions, which are invalid because they are contrary to the mandatory provisions of the law, and the latter shall be treated differently according to the general entry into force of the contract, For example, the paid surrogacy agreement is invalid because of violating the principle of social public interest, and the free full surrogacy is not invalid of course. Therefore, the legal parents of surrogate children should not be determined according to the surrogate agreement, but the legal mother of surrogate children should be recognized as the provider of uterus. Subject to the adoption law and with the consent of the trustee, the principal may adopt a surrogate child and establish a parent-child relationship.
