论改革开放以来中国共产党依法治国的思想与实践

【摘要】：改革开放以来,中国共产党依法治国思想与实践逐步发展、深化。以邓小平同志为代表的党的第二代领导集体积极进行拨乱反正,为我国的法制建设寻找正确方向,并将工作重点转移到以“一个中心,两个基本点”的社会主义经济建设上来;法治建设得到了恢复、重组和发展,逐步得到健全和完善,我国的治国思想逐步完成了从“人治”到“法治”的重要转变。党的十五大首次把依法治国定义为国家建设的发展战略,最终建成社会主义法制国家;党的十六大又制定了建设社会主义法制国家的基本原则;党的十七大对全面部署依法治国制定了发展战略;十八大把全面实施依法治国确定为国家进行政治建设和体制改革的根本。依法治国思想与实践的研究,对于坚持人民民主,继承和发扬具有我国特色的政治发展理论,全面实现小康社会,最终实现我国伟大复兴的中国梦具有极其重要的意义。全面研究和阐释改革开放,坚持依法治国理念,注重实践,有利于完善社会主义政治体制,有利于实现建立社会主义法制国家的远大理想。本文以中国共产党依法治国基本方略为视角,分析了依法治国思想的理论体系及其内涵,概括了历代领导人关于依法治国思想的发展创新与实践路径,文章最后通过归纳总结改革开放以来中国共产党依法治国的基本经验,得出了贯彻和落实依法治国思想的现实启示,体现了依法治国思想保障人的全面发展和实现以人为本价值观、促进了良好法治秩序的形成、保证社会主义和谐社会的构建的重要价值。
[Abstract]:Since the reform and opening up, the CPC's thought and practice of governing the country according to law have gradually developed and deepened. The second generation of the leading collective of the Party, represented by Comrade Deng Xiaoping, actively carried out the rectification of the disorder, sought the correct direction for the legal system construction of our country, and shifted the focus of the work to the socialist economic construction with "one center, two basic points"; The construction of the rule of law has been restored, reorganized and developed, and gradually perfected and perfected. Our country's thought of governing the country has gradually completed the important transformation from "rule by man" to "rule by law". For the first time, the 15th National Congress of the Party defined the rule of law as the development strategy of national construction, and finally established a socialist legal state, and the 16th National Congress of the Party formulated the basic principles for building a socialist legal state. The Seventeenth National Congress of the Communist Party of China has formulated a development strategy for the overall arrangement of administering the country according to law, and the 18th National Congress has decided that the overall implementation of the rule of law is the basis for the political construction and institutional reform of the country. The study of the thought and practice of governing the country according to law is of great significance for upholding the people's democracy, inheriting and carrying forward the theory of political development with Chinese characteristics, realizing a well-off society in an all-round way, and finally realizing the great rejuvenation of our country, Chinese Dream. Comprehensive study and interpretation of reform and opening up, adhere to the concept of rule of law, pay attention to practice, is conducive to the improvement of the socialist political system, conducive to the establishment of a socialist legal system of the lofty ideal. From the perspective of the CPC's basic strategy of governing the country according to law, this paper analyzes the theoretical system and connotation of the thought of governing the country according to law, and generalizes the development, innovation and practical path of the thought of governing the country by law of the leaders of the past dynasties. Finally, by summing up the basic experience of the CPC in governing the country according to law since the reform and opening up, the article draws the realistic enlightenment of carrying out and carrying out the thought of governing the country by law. It embodies the idea of governing the country according to law to ensure the all-round development of people and realize the value of people-oriented, promotes the formation of a good order of rule of law, and ensures the important value of building a harmonious socialist society.
