自然法理论历史的克莱因瓶模型

【摘要】：古典自然法理论、现代自然法理论和新古典自然法理论,共同构成了自然法理论的历史。前两者之间既有古今之变的断裂,也有藕断丝连的衔接,而新古典自然法理论的介入使得它们的关系更加复杂。这一复杂的理论历史,在"克莱因瓶"的模型中融贯起来。而理解这一模型的关键,便是"神法"。这一概念不仅揭示了现代自然法理论和古典自然法理论的"断裂"是如何被构建起来的,而且也展示了二者是如何一脉相承的,进而呈现出自然法理论历史的整全性。
[Abstract]:Classical natural law theory, modern natural law theory and neoclassical natural law theory together constitute the history of natural law theory. The relationship between the former two is not only the fracture of ancient and modern changes, but also the connection of coupling between them, and the involvement of neoclassical natural law theory makes their relationship more complicated. This complex theoretical history is embedded in the model of Klein bottle. The key to understanding this model is the divine law. This concept not only reveals how the "fracture" of modern natural law theory and classical natural law theory is constructed, but also shows how the two theories are inherited in the same vein, thus showing the integrality of the history of natural law theory.
