清代法律位阶关系新论——以《大清律例》和《户部则例》的关系为例

【摘要】：作为清代法律体系的主干法律,《大清律例》与包括《户部则例》在内的部门则例均是具有重要实用功能的基本法典,它们分属于不同的门类,在调整方法和条文内容等方面具有互补性。就法律体系内部的效力等级而言,《大清律例》并不存在凌驾于《户部则例》之上的法律位阶,它们在不同的领域发生作用,彼此间是一种分工与配合的关系。部门则例是中国传统法律部门发展完善的最后阶段,标志着清代法律体系已发展成为中国传统法制的完备形态。
[Abstract]:As the main legal system of the Qing Dynasty, the laws and regulations of the Qing Dynasty and the rules of the Department including the rules of the Ministry of Housing are basic codes with important and practical functions, and they belong to different categories. It is complementary in adjusting methods and contents of articles. In terms of the level of effectiveness within the legal system, there is no legal rank above the rules of the Ministry of Housing, which play a role in different fields and are related to each other in a division of labor and cooperation. The code of law is the last stage of the development and perfection of Chinese traditional law department, which indicates that the legal system of Qing Dynasty has developed into a complete form of Chinese traditional legal system.
