伊斯兰教对新疆少数民族习惯法的影响初探

【摘要】：众所周知,新疆自古以来就是一个多民族生活聚居的地区,同时也是一个多种宗教并存的地区。在新疆地区的少数民族中,伊斯兰教经过长期的历史发展演变,其教义教法已深深地根植于广大信教群众的思想意识之中,并融入到他们的生产生活当中,演化为习惯法的重要内容。直到当今社会,伊斯兰教仍然对新疆各信教少数民族的习惯法发挥着不可忽视的作用。 本文从宗教与习惯法的法理学关系入手,依托伊斯兰教法作为理论分析工具,从宗教禁忌与宗教仪式等形式方面到包括婚姻、继承、商事、债权等具体内容方面阐述伊斯兰教对新疆少数民族习惯法存在的影响。进而在理论层面上探讨伊斯兰教在新疆少数民族习惯法中的功能作用。在此基础上提出,研究伊斯兰教对新疆少数民族习惯法的影响对于当今社会法治建设的开展有良好的借鉴作用,对于我们今天在新疆搞好民族关系,做好宗教工作,维护社会稳定,促进民族地区经济和文化的发展有很大的帮助。
[Abstract]:As we all know, Xinjiang has been a multi-ethnic living area since ancient times, but also a multi-religious region. Among the ethnic minorities in Xinjiang, after a long period of historical development and evolution, the teaching and law of Islam has been deeply rooted in the ideological consciousness of the vast number of religious people, and has been incorporated into their production and life. The evolution of customary law into an important content. Until now, Islam still plays an important role in the customary law of religious minorities in Xinjiang. This article starts with the legal relationship between religion and customary law, relies on Islamic Shariah as a theoretical analysis tool, from religious taboos and religious rituals to including marriage, inheritance, commercial, and so on. The author expounds the influence of Islam on the existence of ethnic minority customary law in Xinjiang in terms of creditor's rights and other specific contents. Then on the theoretical level, this paper discusses the function of Islam in the customary law of ethnic minorities in Xinjiang. On this basis, it is pointed out that studying the influence of Islam on the customary law of ethnic minorities in Xinjiang has a good reference for the development of the construction of rule of law in today's society, and for us to do a good job in ethnic relations and religious work in Xinjiang today. Maintaining social stability and promoting the economic and cultural development of ethnic areas is of great help.
