超范围使用食品添加剂应适用十倍赔偿

【摘要】：正【裁判要旨】在食品安全领域,消费者主张十倍赔偿,系以食品不符合食品实质性安全标准为核心要件,不以产生实际人身损害为前提。生产者超范围使用食品添加剂的,消费者可以要求生产者承担支付十倍价款之赔偿责任。
[Abstract]:In the field of food safety, consumers claim ten-fold compensation, which is based on the fact that food does not meet the material safety standards of food as the core element, and does not take actual personal injury as the premise. If a producer uses food additives in an extended range, the consumer may demand that the producer be liable to pay ten times the price.
