中国礼俗社会与法理社会的更替

【摘要】：中国长期处于农业经济占主导地位的封建社会,礼俗社会的"情、理、法"思维根植于国民性格之中。全球史观认为,现阶段人类历史处于市场经济为主导的资本主义时期,法理社会是市场经济正常运行的基本环境。依法治国的基本方略自中共十五大提出以来,已近二十年,法律和情理的矛盾依然存在中国法制建设的方方面面。本文即从中国乡土社会的传统习惯出发,分析矛盾成因,寻求解决办法。
[Abstract]:China has been in a feudal society dominated by agricultural economy for a long time, and the thinking of "emotion, reason and law" in etiquette and custom society is rooted in Yu Guomin's character. According to the view of global history, human history is in the capitalist period dominated by market economy at present, and the legal society is the basic environment for the normal operation of market economy. Since the 15th National Congress of the Communist Party of China (CPC), the basic strategy of governing the country according to law has been nearly 20 years, and the contradiction between law and reason still exists in all aspects of China's legal construction. Starting from the traditional habits of Chinese local society, this paper analyzes the causes of contradictions and seeks solutions.
