“苏力问题”中的问题

【摘要】：苏力在《法治及其本土资源》一书中提出了"苏力问题"。"苏力问题"的内涵在于通过揭示法治及其本土资源之间的某些冲突,以及法治在本土环境及现实生态中所遭遇的某些窘境而提出了外引的法治或现代法治为何(如何)同中国本土中传统的治理资源及现实社会环境相协调或融合,并藉此进一步通向对"中国应当实行什么样的法治"以及"怎样实行法治"这一重大问题的思考和追问。但受历史条件以及苏力个人视野和思维方式的局限,苏力在"苏力问题"中蕴含的"问题意识"更多地诉诸个人的直感,没有深入地揭示出乡土治理的实践逻辑,同时,由于苏力偏执地捍卫本土因素,因而在分析和认识问题时其所持的立场也在一定程度上偏离了法学人所应守持的某些底线。20年后重新研究"苏力问题",应有更加开阔的视野、更为宏观的主题,以及更为理性的心态和恰当的理论期待。
[Abstract]:In his book the Rule of Law and its Local Resources, Su Li put forward the problem of Su Li. " The connotation of Su Li problem is to put forward the external rule of law or modern rule of law by revealing some conflicts between the rule of law and its local resources, as well as some dilemmas encountered by the rule of law in the local environment and the real ecology, and how to coordinate or integrate with the traditional governance resources and the real social environment in China. This leads to the thinking and inquiry of "what kind of rule of law should be implemented in China" and "how to implement the rule of law". However, limited by historical conditions, Su Li's personal vision and mode of thinking, Su Li's "problem consciousness" in "Su Li problem" resorts to personal directness more, and does not reveal the practical logic of local governance in depth. At the same time, because Su Li is paranoid in defending local factors, Therefore, his position in the analysis and understanding of the problem also deviates from some of the bottom lines that the legalists should hold to a certain extent. 20 years later, the re-study of the "Su Li problem" should have a broader vision, a more macro theme, as well as a more rational state of mind and appropriate theoretical expectations.
