基于人性视角的法律规则来源分析

【摘要】：法律规则的来源是什么,法律规则以什么为基础,是人类进入轴心时代以来讨论的永恒主题。传统的哲学家以思辨的方法从多方面讨论了人的本性,得出法律的规则来源于人,来源于人的本性。现代心理学的三次思潮则运用实证的手段,对人性的讨论更具科学性。从对人性的讨论并结合法律构成的基本要素分析可以得出,法律规则的设定关键在于约束人、发展人、实现人的自由个性,法律应以人为基础。
[Abstract]:What is the origin of the rule of law, what is the basis of the rule of law is the eternal theme that has been discussed since the time when mankind entered the axis of the axis. The traditional philosophers have discussed the nature of the human from various aspects by the way of thinking, and the rule of the law comes from the human nature and comes from the human nature. The third thoughts of modern psychology use the means of demonstration, and the discussion of human nature is more scientific. From the analysis of the human nature and the basic elements of the legal constitution, it can be concluded that the key to the rule of law is to restrain the person, the development person, the realization of the person's free personality, and the law should be the man-made basis.
