青海藏区民间调解法律问题研究——藏传佛教寺院僧侣参与人身伤亡案件调解的思考

【摘要】：对于青海藏区藏传佛教寺院僧侣参与人身伤亡案件的民间调解行为,学界对其行为属性语焉不详,认识较为模糊。本文指出藏区僧侣们在民间调解中,主要运用的是文化权力———付出符号劳动,享有符号权力,甚至实施符号暴力,从而说明其在藏区民间纠纷调解中的行为并不具有超功利和非经济型的特征。对于青海藏区藏传佛教寺院僧侣参与人身伤亡案件的民间调解行为,学界对其行为属性语焉不详,认识较为模糊。本文指出藏区僧侣们在民间调解中,主要运用的是文化权力——付出符号劳动,享有符号权力,甚至实施符号暴力,从而说明其在藏区民间纠纷调解中的行为并不具有超功利和非经济型的特征。
[Abstract]:In the case of the folk mediation of the Tibetan Buddhist temple monks in the Tibetan area of Qinghai in the case of personal injury and death, the language of its behavior is unknown, and the cognition is more vague. This paper points out that in the folk mediation, the monks of the Tibetan area mainly use the cultural power _ to pay the symbol labor, to enjoy the symbol power, and even to implement the symbol-based violence, so that the behavior of the folk dispute mediation in the Tibetan area does not have the characteristics of ultra-utility and non-economic. In the case of the folk mediation of the Tibetan Buddhist temple monks in the Tibetan area of Qinghai in the case of personal injury and death, the language of its behavior is unknown, and the cognition is more vague.
