福建省平潭综合实验区社区矫正实证研究

【摘要】：社区矫正制度的推行,是中国顺应刑罚制度和措施向轻缓化发展的全球化趋势的重要体现。从2002年司法部成立研究小组,到2003年在全国六个省(市)进行试点实施,到2009年在全国全面试行,社区矫正表现了强大的生命力。各地也通过不断的探索研究,积累了很多值得推广的经验,取得了良好的社会效果和政治效果。但由于受社会经济发展水平、社会普遍法律理念以及传统观念等因素的影响,无论是在刑事理论上还是在司法实践中,各地都仍需要探索更符合本土化要求的社区矫正工作模式。因此,本文立足于福建省平潭综合实验区(以下简称“平潭”)的社区矫正工作实践,对平潭社区矫正管理部门、服刑人员及普通居民等社区矫正工作的相关人员展开全方位的调查,力求从基层治理中探索更有效的社区矫正工作模式。本篇论文由导论、正文和结语三个部分组成,其中正文是由四个部分构成。第一部分：阐明了社区矫正的概念及其理论依据和现实意义。首先对社区矫正的相关概念进行辨析,接着阐述实施社区矫正的相关理论依据,最后说明了实施社区矫正的重要意义。第二部分：平潭社区矫正实施状况的调查分析。本部分以平潭为案例,简要阐述了平潭社区矫正实施状况的调查背景,选取对服刑人员和普通居民进行问卷调查和对各级社区矫正机构负责人、基层社区矫正工作人员进行实地访谈,倾听和了解社区矫正第一线工作实施情况,作为本文所提出观点的基础。第三部分：平潭社区矫正工作存在的问题及其原因分析。在第二部分全面了解平潭社区矫正实施现状和调查分析工作实施效果的基础上,深入分析了平潭社区矫正工作中存在的若干问题及原因。第四部分：本部分针对第二部分实施状况的调查分析和第三部分总结的问题及原因分析,提出了完善平潭社区矫正工作的对策,为其他区域做好社区矫正工作提供有益的启示与借鉴。
[Abstract]:The implementation of the Community Correction system is an important embodiment of the globalization trend of China's compliance with the penal system and measures. Since 2002, the Ministry of Justice has set up a research group. By 2003 in the national six provinces (cities) pilot implementation, 2009 in the country in a comprehensive trial, community correction has shown a strong vitality. All over the country through continuous exploration and research. Accumulated a lot of experience worthy of promotion, achieved good social and political effects, but due to the level of social and economic development, the general legal concept of society and traditional ideas and other factors. Whether in criminal theory or in judicial practice, there is still a need to explore more suitable for the requirements of the local community correction work model. This paper is based on the practice of community correction in Pingtan Comprehensive Experimental area of Fujian Province (hereinafter referred to as "Pingtan"), to the management department of Pingtan Community Correction. In order to explore a more effective mode of community correction work, prison inmates and ordinary residents and other community correction work related personnel to carry out an omni-directional investigation. This thesis consists of three parts: introduction, text and conclusion, in which the text is composed of four parts. The first part expounds the concept of community correction and its theoretical basis and practical significance. Firstly, the related concepts of community correction are analyzed, and then the relevant theoretical basis of community correction is expounded. Finally, the importance of community correction is explained. The second part: the investigation and analysis of the implementation of Pingtan Community Correction. This part takes Pingtan as a case to briefly explain the investigation background of the implementation of Pingtan Community Correction. Select the prisoners and ordinary residents for questionnaires and community correction organizations at all levels, grass-roots community correction staff for field interviews, listening to and understand the implementation of the first line of community correction. As the basis of the views put forward in this paper. The third part: Pingtan community correction problems and their causes. In the second part of a comprehensive understanding of the status quo of Pingtan community correction and the results of the investigation and analysis of the implementation of the work on the basis of. Some problems and reasons in Pingtan Community Correction are analyzed in depth. Part 4th: this part aims at the investigation and analysis of the implementation of the second part and the analysis of the problems and reasons summarized in the third part, and puts forward the countermeasures to perfect the community correction work in Pingtan. For other regions to do a good job in community correction to provide useful inspiration and reference.
