论我国女性犯罪的特点、成因及预防

【摘要】：女性犯罪是由女性所实施的,与女性特有的生理和心理特征密切相关的,具有严重社会危害性,并触犯刑法,应该处以刑罚的行为。古今中外,女性犯罪作为一个社会问题和法律问题一直都是存在的,但随着社会的发展,女性犯罪却呈现愈演愈烈之势,引起了国际社会的广泛关注。当下,我国女性犯罪呈现出明显的数量高发、犯罪手段男性化、攻击性强和犯罪主体低龄化等特点。女性犯罪人具有特殊的生理特点和心理特点,这使得女性犯罪也表现出诸多不同于一般犯罪的特殊性,如犯罪手段隐蔽性、欺骗性强；女性犯罪人角色具有从属性、依附性；犯罪行为往往表现出明显的情感性、偶发性和冲动性特征：犯罪年龄出现两头加重的趋势；故意犯罪居多,但过失犯罪数量有所增加；等等。女性犯罪与女性犯罪人自身的生理、心理等内在因素有关,如女性犯罪人依附心理强而辨识能力差；情感丰富细腻但情绪变化快；嫉妒、虚荣、占有欲强；等等。另外,女性犯罪也与各种社会因素有着密切的关系,主要包括：家庭教育、学校教育的缺失；不良友情的影响；不良文化引起的价值取向扭曲；对女性群体社会期望的提高；等等。针对女性犯罪的各种具体原因,提出针对性的预防措施是防止女性犯罪高发的关键。这些预防措施应该包括：消除不良现象,净化社会风气；完善社会教育机制,增强女性自我保护意识；加强对女性权益的法律保护；帮助女性适应社会变革,完成社会角色的转变；加强对女性犯罪人的矫治工作,预防再次犯罪的发生；等等。
[Abstract]:Female crime is carried out by women, and is closely related to physiological and psychological characteristics of women, with serious social harm, and violate the criminal law, should be sentenced to a criminal punishment behavior. As a female crime at all times and in all countries, social and legal issues have been put in, but with the development of society, female crime it is getting worse, caused widespread concern in the international community. At present, the female crime in China shows a high number of obvious masculine characteristics, means of crime, aggressive and crime younger age.
The female offender has special physiological and psychological features, which makes the female crime also exhibit many different from the general crime particularity, such as criminal means hidden, deceptive strength; the female offender has roles from the property, dependence; crime often showed obvious emotional, sporadic and impulsivity two: age aggravated crime; intentional crime mostly, but an increase in the number of criminal negligence; and so on.
Physiology of female crime and female crime itself, the inherent psychological factors, such as the female offender psychological dependence and strong identification ability; emotional delicate but quick mood changes; jealousy, vanity, possessive; and so on. In addition, female crime and other social factors closely related, including: the lack of family education, School education; the adverse effects of friendship; distorted value orientation caused by the bad culture; on female social expectation to improve; and so on.
According to the specific reasons of female crime and put forward the prevention measures is the key to prevent the female crime. These preventive measures should include: to eliminate the phenomenon, purify the social atmosphere; improve the social education mechanism, enhance women's awareness of self-protection; strengthen the legal protection of the rights of women; to help women to adapt to the social change, social transformation the role of women; strengthen treatment of offenders, prevent crime again; and so on.
