论我国劳动教养制度的司法性改造问题

【摘要】： 劳动教养初创于20世纪50年代我国的肃反运动期间,发展于1978年之后。50多年来,该制度在维护社会治安,预防和减少犯罪,教育和挽救轻微违法犯罪人员等方面起到了积极的作用。但随着我国社会、经济、政治、文化等方面的发展,其存在的一些问题和缺陷亦日益凸显,并在中外法学界引起了较大的争议。特别是收容遣送制度废除后,劳动教养制度何去何从的问题一时间被推到了风口浪尖,再次成为一个引人注目的焦点。因此,对现行的劳动教养制度进行必要的改革,既能适应21世纪新形势下与轻微违法行为作斗争的需要,又符合我国的社会主义法治理念,而且能为维护社会稳定,保障社会主义经济建设和构建社会主义和谐社会作出更大的贡献。本文首先闸述了劳动教养制度的历史沿革及现状,进而通过对劳动教养制度的反思,从合理性和缺陷性两方面对其进行了全面的分析,并结合当前劳动教养制度的存废之争,得出了劳动教养制度改革势在必行的观点,最后对劳动教养制度的司法性改造进行了深入的论述并提出了具体的建议和措施。本文尝试通过理论与实践的结合,探讨我国的劳动教养制度的改革与完善,以使其在我国社会主义法治进程中发挥更为积极有效的作用。
[Abstract]:During the Anti-Rebellion Movement in the 1950s and after 1978, the reeducation through labor system was established in order to maintain public order and to prevent and reduce crime.Education and rescue of minor offenders and other aspects played a positive role.However, with the development of our society, economy, politics, culture and so on, some problems and defects have become increasingly prominent, and have aroused great controversy in the field of law at home and abroad.Especially after the abolition of the system of reception and repatriation, the question of what to do with the system of re-education through labour has been pushed to the forefront of the storm and has once again become the focus of attention.Therefore, the necessary reform of the current system of re-education through labour can not only meet the needs of the struggle against minor illegal acts in the new situation of the 21st century, but also conform to the socialist concept of the rule of law in our country, and also be able to maintain social stability.To ensure socialist economic construction and build a socialist harmonious society to make greater contributions.This paper first describes the historical evolution and current situation of the reeducation through labor system, and then through the reflection of the system of re-education through labor, from the rationality and defect of two aspects, and combined with the current struggle for the retention and abolition of the system of re-education through labor.Finally, the author discusses the judicial reform of the reeducation through labor system and puts forward some concrete suggestions and measures.Through the combination of theory and practice, this paper attempts to probe into the reform and perfection of our country's reeducation through labor system, so as to make it play a more active and effective role in the process of socialist rule of law in our country.
