我国社区矫正实践中的问题及对策思考——以陕西省社区矫正试点工作为例证的分析

【摘要】：社区矫正是行刑社会化、人道化的必然表现形式,在刑罚谦抑性思想和"预防犯罪、减少犯罪、化解矛盾、促进和谐"的刑事法律制度和行刑理念的推动下,两高两部联合下发了《关于开展社区矫正试点工作的通知》,各地据此开展了社区矫正的实践。陕西省于2010年全面推行了社区矫正工作试点,在此期间,由于各项基本条件的限制,公检法司配合协调不到位,群众认同度不高,又缺乏法律依据,使得此项工作的推进受到很大的制约。为此,需要完善相关立法,确定编制机构和保障经费,做好宣传教育工作,提高人们的思想认识,做好公检法司各方的配合、协调,有效推进社区矫正工作,保证刑事法律制度和行刑理念的落实。
