劳教所强制隔离戒毒问题研究

【摘要】：当前毒品泛滥问题形势严峻对我国经济建设和和谐社会建设已经构成了重大隐患,对我国的公共管理能力也是一次巨大的考验。2008年6月1日正式施行的《中华人民共和国禁毒法》(以下简称《禁毒法》)规定,今后我国禁毒体系主要由社区戒毒和强制隔离戒毒构成,强制隔离戒毒将取代现行的公安机关管理的强制戒毒和司法行政机关管理的劳教戒毒。劳教场所强制隔离戒毒工作启动以来,大多数劳教戒毒所都是照搬或者参照过去劳教戒毒模式,很多工作还处于探索阶段。目前,对于转型中的劳教戒毒场所及管教民警,如何切实执行《禁毒法》,充分保障强制隔离戒毒人员合法权益,最大限度提高戒断率、降低复吸率,更好地适应戒毒工作新形势发展的需要就显得意义重大。本文以我国严峻的毒品形势及当前禁毒斗争深入、禁毒格局发生了深刻的变化为背景,以《禁毒法》和劳教戒毒管理为研究基础,探讨了劳教场所实施强制隔离戒毒这一新的命题。首先对劳教所实施强制隔离戒毒管理的必要性和可行性进行了分析,接着指出了目前劳教所强制隔离戒毒管理存在的问题及原因,进而针对强制隔离戒毒管理存在的问题及原因提出了相应的对策建议。通过分析和研究,本文得出以下结论: 1、劳教所以往采用的重罚轻戒模式管理的吸毒人员,其戒毒效果经不起时间的考验,并且他们对融入社会的信心不足,容易造成戒毒失败,再次复吸。产生这样结果的原因是吸毒人员被定位为违法人员,强制、被动服从的戒毒管理,戒毒方面流于形式。 2、在确立强制隔离戒毒工作理念时,应将戒毒目标由戒毒事实转向戒毒人员。即将“戒断毒瘾”转变为“戒断或减少使用毒品,降低毒品危害,促进戒毒者生理、心理和社会功能的恢复”。强制隔离戒毒管理工作需要建立集生理脱毒、身心康复、重返社会于一体的戒毒康复“三位一体”综合管理新模式。 3、戒毒学员的家庭参与戒毒工作是一项义不容辞的义务。将戒毒学员的家庭状况以及关爱、帮教情况纳入考核、评估内容十分重要。 4、针对目前我国社区戒毒不完善及自愿戒毒和戒毒康复两项戒毒措施很难取得预期的社会效益的情况下,探索实施“模拟社区”康复制度,这也是以提高教育矫治质量和维护戒毒学员合法权益为出发点,方法人道,内容富有时代特征,没有突破现有法律和方针政策指导范围,符合创新导向,对探索发展强制戒毒事业具有重大意义。戒毒工作任重而道远,尤其在戒毒管理工作深层次问题分析方面,仍有待于未来的研究作进一步的探讨。在今后的工作中,我们将坚持科学发展观,不断探索戒毒工作的内在规律,努力推进戒毒工作的规范化、制度化和科学化,努力为全面建设小康社会,维护社会稳定和人民群众安居乐业,创造良好的社会环境,为构建社会主义和谐社会做出新贡献。
[Abstract]:At present, the serious situation of drug flooding has posed a major hidden danger to the economic construction and the building of a harmonious society in our country. The law of the people's Republic of China on Drug Control (hereinafter referred to as "the Law on Drug Control"), which came into effect on June 1, 2008, is also a great test of our country's public administration. In the future, the drug control system of our country is mainly composed of community detoxification and compulsory isolation detoxification. Compulsory isolation detoxification will replace the compulsory detoxification administered by the current public security organs and reeducation-through-labor detoxification managed by the judicial administrative organs Since the start of compulsory isolation and detoxification in re-education through labor facilities, most of the rehabilitation centers have copied or referred to the past reeducation-through-labor detoxification model, and many of the work is still in the exploratory stage. At present, how to effectively implement the Drug Control Law to fully protect the legitimate rights and interests of drug addicts in compulsory isolation, and to maximize the withdrawal rate and reduce the relapse rate for the reform-through-labor detoxification centers and police officers in transition, It is of great significance to better adapt to the needs of the development of the new situation of detoxification. This paper is based on the severe drug situation and the current drug control struggle in China, the profound changes in the drug control pattern, and the research foundation of the "Drug Control Law" and the administration of reeducation through labor and detoxification. This paper discusses the new proposition of compulsory isolation and detoxification in reeducation institutions. This paper first analyzes the necessity and feasibility of compulsory segregated detoxification administration in reeducation centers, and then points out the existing problems and causes of compulsory isolation detoxification management in reeducation centers. Then, the paper puts forward corresponding countermeasures and suggestions on the problems and causes of compulsory isolation drug treatment management. Through analysis and research, this paper draws the following conclusions: 1. The drug addicts who used heavy punishment and light abstinence mode in the past can not stand the test of time, and their confidence in integrating into the society is not enough, which is easy to cause drug abuse failure and relapse. The reason for this result is that drug addicts are classified as illegal, compulsory, passive drug treatment management, detoxification is a formality. 2. In establishing the concept of compulsory isolation, the goal of detoxification should be shifted from detoxification to detoxification. "withdrawal from drug addiction" will be transformed into "abstinence or reducing the use of drugs, reducing drug harm, promoting the recovery of the physical, psychological and social functions of drug addicts". It is necessary to establish a new comprehensive management model of detoxification, physical and mental recovery and social reintegration. 3. It is an unshirkable duty for the families of drug addicts to participate in the work of detoxification. It is very important to assess the family status, care, help and education of drug addicts. (4) in view of the fact that the community detoxification in our country is not perfect and that the two measures of voluntary detoxification and rehabilitation are difficult to achieve the expected social benefits, we should explore the implementation of the "simulated community" rehabilitation system. This is also based on improving the quality of education and treatment and safeguarding the legitimate rights and interests of drug addicts. The method is humane, the content is full of the characteristics of the times, it does not break through the scope of existing laws, principles and policies, and is in line with the orientation of innovation. It is of great significance to explore and develop the cause of compulsory detoxification. The work of detoxification has a long way to go, especially in the aspect of deep problem analysis of drug treatment management, which still needs to be further studied in the future. In our future work, we will adhere to the scientific concept of development, constantly explore the internal laws of drug rehabilitation, strive to promote the standardization, institutionalization and scientization of drug treatment work, and strive to build a well-off society in an all-round way. Maintaining social stability and people living and working in peace and contentment, creating a good social environment, and making new contributions to the construction of a socialist harmonious society.
