【摘要】： 本文在回顾劳动教养制度产生过程的基础上,对我国现价段的劳动教养制度存在的合理性进行剖析,在分析劳动教养制度性质的基础上,对现阶段劳动教养制度存在的问题进行分析,又对当前社会热议的保安处分能否适用于我国进行了论证,最后在总结以上论点的基础上对如何进一步改革和完善劳动教养制度提出了自己的观点。全文共分为六大部分。一、劳动教养制度的回顾和发展。通过对劳动教养制度建立过程的回顾,指出劳动教养制度在我国社会主义建设过程中发挥的重要作用。二、劳动教养制度存在的现实合理性。通过对现行中国法律制裁体系中的空白和社会治安形势的需要来论证劳动教养制度的现实合理性。三、劳动教养制度的性质,从劳动教养制度的法律渊源、适用对象、审批程序和法律后果承担方式来论述劳动教养制度的性质。四、劳动教养制度存在的问题。通过对劳动教养制度和国内国际的法律冲突以及劳动教养制度自身存在的问题来分析劳动教养制度存在的问题。五、我国引入保安处分的设想。通过国外保安处分的发展和我国劳动教养制度的比较来分析我国引入保安处分制度的可行性。六、劳动教养制度的完善。在以上论点的基础上总结提出未来替代劳动教养制度在名称、立法原则、对象范围、审批程序和执行方式上的改革。改革劳动教养制度要立足与中国现阶段国情,在保持稳定的基础上,在行政审批程序中引入司法权,尝试建立符合社会主义法制要求的制度。
[Abstract]:On the basis of reviewing the process of reeducation through labor system, this paper analyzes the rationality of the existing system of reeducation through labor at present price in our country, on the basis of analyzing the nature of reeducation through labor system. This paper analyzes the problems existing in the current system of re-education through labor, and demonstrates whether the security measures discussed in the current society can be applied to our country. Finally, on the basis of summing up the above arguments, the author puts forward his own views on how to further reform and perfect the system of reeducation through labor. The full text is divided into six parts. First, the review and development of the reeducation through labor system. By reviewing the establishment process of the reeducation through labor system, this paper points out the important role of the reeducation through labor system in the process of socialist construction in our country. Second, the realistic rationality of the existence of reeducation through labor system. Through the blank in the current legal sanction system of China and the need of the social security situation, this paper proves the realistic rationality of the reeducation through labor system. Third, the nature of reeducation through labor system, from the legal origin, applicable object, examination and approval procedure and legal consequence bearing way to discuss the nature of reeducation through labor system. Fourth, the problems existing in the system of reeducation through labor. This paper analyzes the problems existing in the system of reeducation through labor through the conflict of laws between domestic and international countries and the problems existing in the system of reeducation through labor. Fifth, our country introduces the idea of security measures. Through the development of foreign security measures and the comparison of the system of reeducation through labor in China, the feasibility of introducing the system of security measures in China is analyzed. Sixth, improve the system of reeducation through labor. On the basis of the above arguments, this paper sums up the reform of the future alternative reeducation through labor system in terms of name, legislative principle, object scope, examination and approval procedure and execution method. The reform of the reeducation through labor system should be based on the current situation of China, on the basis of maintaining stability, introducing judicial power into the administrative examination and approval procedure, and trying to establish a system that meets the requirements of the socialist legal system.
