公安改革进程中的警务督察制度完善研究

【摘要】：法律赋予公安机关许多特殊权力,公安队伍始终处在应对各种社会矛盾的第一线,稍有不慎就会酿成事端,处于舆论关注的焦点,所以公安机关必须建立科学、严格、有效的监督体制。1997年,公安部建立了警务督察制度,这对推动整个公安机关和全体人民警察严格、公正、文明执法起了不容忽视的作用。然而,随着全面深化改革带来的社会转型、经济转轨以及利益分配变化,使得整个社会的矛盾和冲突快速增长,这就给公安机关工作带来了更为复杂严峻的执法环境和形势。为适应这一变化,公安系统开始启动全面深化公安改革,旨在将其职责和效能更好的发挥出来,为新时期深化改革的全局提供一个安定团结的社会环境。在这种形势下,建立时间不长的警务督察制度就显得不够完善,不能完全适应公安工作的需要。因此,警务督察制度必须要尽快完善,这样才能更充分的强化其对各类警务活动的监督和制约作用,确保公安机关的工作符合人民群众的期望,为全面深化公安改革目标的达成提供保障。本文旨在探索如何完善警务督察制度。首先,介绍了警务督察制度的发展历程和基本概念,以及其机构、职权和监督特点,并分析了全面深化公安改革与完善警务督察制度的相关性。接着,根据X县的警务督察工作情况,深刻剖析了警务督察制度存在的问题,如思想认识有偏差、组织架构不规范、职能权限不明确、人员素质不整齐、法规制度不完善和责任追究缺力度等。然后,介绍美国、英国、法国、日本以及中国香港地区的警务监督模式的主要特点,并总结出监督部门单一化、监督权力法定化、监督权威强效化、监督程序科学化和监督内外结合化等五条具有共性的经验做法。最后,文章提出如何在公安改革背景下进一步完善我国警务督察制度的对策构想,包括全面提高警务督察意识、合理配置警务督察职权、逐步健全督察法规制度、统一规范警务督察机构、大力提升督察人员素质、创新发展科学督察方式和切实加强责任追究力度。
[Abstract]:The law gives the public security organs many special powers, and the public security forces are always at the forefront of dealing with various social contradictions. A slight carelessness will lead to trouble and focus of public opinion. Therefore, the public security organs must establish a scientific and strict system. In 1997, the Ministry of Public Security established the police supervision system, which played an important role in pushing the whole public security organ and all the people's police to enforce the law strictly, impartially and civilly. However, with the social transformation, economic transition and benefit distribution changes brought by the comprehensive deepening of the reform, the contradictions and conflicts of the whole society grow rapidly, which brings a more complicated and severe law enforcement environment and situation to the work of the public security organs. In order to adapt to this change, the public security system started to deepen the public security reform in an all-round way in order to bring its duty and efficiency into full play, and to provide a stable and United social environment for deepening the reform in the new period. In this situation, the establishment of a police inspector system for a short period of time is not perfect enough to fully meet the needs of public security work. Therefore, the police supervision system must be perfected as soon as possible, so as to strengthen more fully its supervision and restriction on all kinds of police activities, and to ensure that the work of the public security organs meets the expectations of the people. To provide a guarantee for the realization of the goal of deepening the reform of public security in an all-round way. The purpose of this paper is to explore how to perfect the police supervision system. First of all, it introduces the development course and basic concept of the police supervision system, as well as its organization, authority and supervision characteristics, and analyzes the correlation between deepening the police security reform and perfecting the police supervision system. Then, according to the work situation of police inspector in X County, the problems existing in the police supervision system are deeply analyzed, such as the deviation of ideological understanding, the non-standard organizational structure, the unclear function and authority, and the irregular quality of the personnel. The laws and regulations system is imperfect and the responsibility investigation lacks the strength and so on. Then, it introduces the main characteristics of the police supervision mode in the United States, Britain, France, Japan and Hong Kong, China, and concludes that the supervision department is unitary, the supervision power is legalized, and the supervision authority is more effective. The scientific supervision procedure and the combination of internal and external supervision are five common practices. Finally, the article puts forward some countermeasures to perfect the police supervision system under the background of public security reform, including raising the police inspector's consciousness in an all-round way, rationally allocating the police inspector's powers and powers, and gradually perfecting the supervision law and regulations system. Unified and standardized police inspectors, vigorously improve the quality of inspectors, innovation and development of scientific supervision methods and strengthen accountability.
