【摘要】： 建设社会主义新农村,是全面构建社会主义和谐社会的必然要求,是落实科学发展观的重大历史任务,正在变化和发展中的中国农村,再次成了整个社会关注的新热点。社会主义新农村建设是一项宏大的系统工程,涉及农林水利、土地交通、教科文卫、社会保障、扶贫开发等众多行业和领域,中央和地方各级政府出台的政策措施多,投入的建设资金和支农惠农资金巨大。当前新农村建设中职务犯罪时有发生,成为破坏农村经济发展,侵害农民权益及影响农村社会稳定的重要因素。在农村土地流转、农民的征地拆迁与补偿安置、农村基础设施建设、农村工程项目建设、涉农专项款物管理等领域,农林部门、农村基层干部掌管、经手的资金项目越来越多,资金量也随之增加,职务犯罪的机率也在增大。因此,选择新农村建设中职务犯罪进行研究,有利于完善此类案件的侦查对策,有利于建立健全打击此类犯罪的长效机制,为建设社会主义新农村保驾护航。本文在写作过程中查阅了不少文献资料,运用了比较、逻辑求证、历史、实证等研究方法,融入自己一些观点的基础上创作完成的。本文正文分为三个部分: 第一部分内容是社会主义新农村建设中职务犯罪概论。主要介绍社会主义新农村建设中职务犯罪的相关概念,从而引出社会主义新农村建设中职务犯罪的含义,系统介绍社会主义新农村建设中职务犯罪的主要表现形式,分析社会主义新农村建设中职务犯罪的原因、特点和危害。社会主义新农村建设中职务犯罪是指社会主义新农村建设中具有一定组织、领导、监督、管理职责的管理人员或依法从事公务的人员利用职务上的便利,滥用职权,玩忽职守,徇私舞弊,故意或过失地实施妨害社会主义新农村建设行为的犯罪。社会主义新农村建设中职务犯罪对社会危害巨大,主要表现在:第一,损害党政机关的形象和威信。第二,职务犯罪对社会主义新农村建设的运作形成阻碍。第三,社会主义新农村建设中的职务犯罪对经济增长产生危害。第四,社会主义新农村建设中的职务犯罪行为对经济体制变革产生危害。第五,社会主义新农村建设中的职务犯罪的出现动摇了广大人民对社会主义新农村建设的组织人员秉公办事的信念。第六,社会主义新农村建设中的职务犯罪毒化社会风气。第二部分内容是社会主义新农村建设中职务犯罪的侦查。主要从侦查策略、宏观侦查方法和微观侦查方法三个方面进行写作。在侦查时间中,如果没有侦查谋略的指导,侦查活动就很难取得成功。侦查人员必须以奇谋良策战胜犯罪分子。职务犯罪的侦查谋略是一般谋略思想尤其是对抗性谋略思想在侦查活动中的运用,它是在侦查人员对职务犯罪分子及其周围环境的充分认识和了解的基础上,结合以往的侦查经验而制定的。制定具体的侦查方法,侦查方法也分为宏观侦查方法和微观侦查方法。宏观侦查方法主要阐述案件侦查中大的方向和侦查方针,侦查过程中没有大方针政策的指导,具体的侦查措施也都无法展开。微观侦查方法就是具体案件的侦查措施。社会主义新农村建设中职务犯罪侦查是一类特殊的职务犯罪侦查,这类案件具有自身的特殊情况,但也可以借鉴其他职务犯罪侦查的一些侦查方法进行侦查。第三部分内容是社会主义新农村建设中职务犯罪的预防对策及建议。主要分成三个大的部分。第一,从教育上预防职务犯罪。第二,检察院与纪委监察部门配合,预防职务犯罪。第三,加强农村基层组织建设、真正做到政务公开、加强财务管理和专项资金管理和完善监督,强化监督。
