变态杀人行为的产生原因及其预防对策

【摘要】： 变态杀人行为是指行为人基于变态心理所实施的故意非法剥夺他人生命权利的行为。变态杀人行为与其它犯罪行为一样,都是由多种因素综合作用而生。促使犯罪人实施变态杀人行为的因素主要有:社会环境因素、个体因素、被害人因素。其中,影响变态杀人行为产生的社会环境因素主要包括不良的家庭因素、不良的学校因素、不良的文化因素。犯罪人个体因素则主要有生物遗传因素、行为人后天自我调控能力低以及行为人人际交往不正常。而被害人因素主要包括被害人的不良生活作风、被害人的低劣素质以及被害人的诱因契合性。针对变态杀人行为的产生原因,应制定三大预防对策:一是社会环境预防;二是个体预防;三是被害人预防。社会环境预防的主要内容是净化家庭环境、改善学校环境、加强对文化传媒的管理及推行心理矫治。个体预防主要是要求个体善于寻求渲泄欲求的正确途径、加强自我调控能力及理性地进行人际交往等。被害人预防则要求人们转变生活作风、提高自身素养以及关注相关报道等。
[Abstract]:Abnormal homicide refers to the intentional and illegal deprivation of the life rights of others by the perpetrator based on abnormal psychology. The abnormal killing behavior, like other crimes, is caused by a variety of factors. The factors that urge criminals to commit abnormal killing are: social environmental factors, individual factors and victim factors. Among them, the social environment factors which influence abnormal killing behavior mainly include bad family factor, bad school factor and bad culture factor. The individual factors of the perpetrator are mainly biogenetic factor, the ability of self-regulation of the perpetrator is low and the interpersonal communication of the perpetrator is abnormal. The victim factor mainly includes the victim's bad life style, the victim's inferior quality and the victim's inducement fit. In view of the causes of abnormal homicide, three preventive countermeasures should be formulated: one is social environment prevention, the other is individual prevention, and the third is victim prevention. The main content of social environmental prevention is to purify the family environment, improve the school environment, strengthen the management of cultural media and carry out psychological correction. Individual prevention mainly requires individuals to be good at seeking a correct way to vent their desires, to strengthen their ability to regulate themselves and to carry out rational interpersonal communication. Victim prevention requires people to change their life style, improve their own literacy and pay attention to relevant reports.
