从言语风格评估看司法场合中存在的男女不平等现象

本文研究由言语风格的评估而导致的在司法场合中因男女性别言语差异而形成的不平等现象。在以“主导”和“差异”为中心的女性主义理论的指导下,本文具体分析了律师和诉讼当事人或辩护人的语言特点。持主导理论研究的会话特点包括会话空间的控制、打断、话题控制、以及挑战。女性言语的特征包括合作性回应、间接、礼貌、以及情感表达。研究结果表明,女律师的话语更多受职业而非性别的限制,所以男女律师在言语方面无明显差异。诉讼当事人或辩护人的言语却受到性别的影响。男女诉讼当事人或辩护人对男律师都比较遵从,而诉讼当事人或辩护人对女律师都很合作。本文运用社会语言学中的言语风格评估理论来探索男女诉讼当事人或辩护人与律师对话时各自的言语特点及由此而产生的影响。旨在发现所处地位和性别对职业律师和诉讼委托人的言语行为的影响,揭示司法环境中因男女语言差异问题而产生的男女不平等待遇现象。
