广东派驻基层检察室制度发展与重构研究

【摘要】：自改革开放以来,我国检察室制度经历了开端、发展、高潮、低谷的复杂发展历程。在全面推进依法治国的新时期,为完善基层法律监督机制,促进检察权力下沉,我国重新开启了检察室制度的探索和实践。广东省是较早开始检察室制度探索的地区之一。由于省内地区间发展不平衡,导致检察室制度构建更复杂、更具难度。研究广东地区检察室制度不仅能考察检察室在经济较发达地区的发展状况,也可以考察检察室在经济欠发达地区的发展状况。本文就是在全国检察室制度重构的大背景下,根据广东省检察室制度的发展特点,将广东检察室制度发展历程划分为三个阶段,即恢复重建前、恢复重建初期和全面依法治国中的检察室制度;分析广东省检察室制度存在的内外困境,包括法律依据不足、规范运行不够、法律监督文化缺失等和基层群体性事件多发影响社会和谐、基层职务犯罪多发危害基层政权稳定、基层法律监督权力制衡缺失等;论述新时期广东检察室制度重构的基本思路、重构的尝试、重构过程中形成的运行模式和启示等。通过梳理广东省检察室制度的发展历程、分析广东省检察室制度的内在困境和外在压力、阐述广东省检察室制度重构的基本思路、尝试和启示,期望达到见微知著的目的,从而为全国检察机关构建检察室制度提供有益借鉴,为提升基层法律监督水平提供样本参照,进而为基层经济、社会发展提供有力司法保障。
[Abstract]:Since the reform and opening up, China's procuratorial office system has experienced the beginning, development, climax, low complex development process. In the new period of comprehensively promoting the rule of law, to improve the grass-roots legal supervision mechanism. To promote the sinking of procuratorial power, China has re-opened the exploration and practice of the procuratorial office system. Guangdong Province is one of the regions that began to explore the procuratorial office system earlier. As a result, the construction of the procuratorial office system is more complex and more difficult. The study of the procuratorial office system in Guangdong can not only investigate the development of the procuratorial office in the economically more developed areas. It is also possible to investigate the development of procuratorial offices in economically underdeveloped areas. This paper is based on the characteristics of the development of the procuratorial office system in Guangdong Province under the background of the reconstruction of the national procuratorial office system. The development of the procuratorial office system in Guangdong is divided into three stages, namely, the procuratorial office system in the early stage of reconstruction and in the comprehensive administration of the country according to law before the restoration and reconstruction; This paper analyzes the internal and external difficulties of the procuratorial office system in Guangdong province, including insufficient legal basis, insufficient standard operation, lack of culture of legal supervision, and frequent mass incidents at the grass-roots level, which affect social harmony. The frequent occurrence of duty crime at the grass-roots level endangers the stability of the grass-roots regime and the lack of checks and balances of the legal supervision power at the grass-roots level; This paper discusses the basic ideas of the reconstruction of the procuratorial office system in Guangdong Province in the new period, attempts to reconstruct the procuratorial office system, the operating mode and the enlightenment formed in the reconstruction process, and combs the development course of the procuratorial office system in Guangdong Province. This paper analyzes the internal predicament and external pressure of the procuratorial office system in Guangdong Province, and expounds the basic ideas, attempts and revelations of the reconstruction of the procuratorial office system in Guangdong Province, in order to achieve the goal of seeing microscopically. Thus it can provide useful reference for the national procuratorial organ to construct the procuratorial office system, provide the sample reference for raising the level of legal supervision at the grass-roots level, and then provide the powerful judicial guarantee for the economic and social development at the grass-roots level.
