论我国基层法院法官助理制度

【摘要】：从我国法官助理制度的试点来看,国家推进法官助理制度是以基层法院为重点。我国基层法院数量占全国法院总数的80%以上,一方面,基层法院的问题一定程度上可以反映我国整个法院系统的普遍性问题,代表了整个法院系统,另一方面我国基层法院有着自己的特点,法官助理制度的试点在基层法院展开,基层的实践经验较为丰富。笔者在此选择以基层法院的法官助理制度为研究对象,从法官助理职能的角度对基层法院的法官助理制度进行论述。我国目前将试点法官助理制度目的,定位为解决基层法官短缺、提高审判效率上,但在实际运行中效果并不显著。针对目前我国基层法院的正式性与非正式性司法的混合性特点,以及基层法官的非专业化与逐渐专业化相结合的特点,在基层法院试点法官助理,赋予其解决基层法院的正式性司法与非正式性司法分离的职能,从而逐步实现我国法院与法官的职业化。考察域外的基层法院法官助理制度如美国、德国、日本,以及我国台湾地区的经验,参考这些地区的法官助理制度的实施与运行情况,结合我国基层法院与法官的特点,提出通过基层法院法官助理管理模式的多元化,同时赋予部分基层法院法官助理以诉讼调解权的途径,以实现基层司法正式性与非正式性的分离。
[Abstract]:Judging from the pilot of our country's assistant system of judges, the national promotion of the system of assistant judges is focused on the grass-roots courts, the number of grass-roots courts in China accounts for more than 80% of the total number of courts, on the one hand. To some extent, the problems of the grass-roots courts can reflect the universality of the whole court system in our country and represent the whole court system. On the other hand, the grass-roots courts of our country have their own characteristics. The trial of the assistant system of judges is carried out in the grass-roots courts, and the practical experience at the grass-roots level is relatively rich. Here, the author chooses the assistant system of judges in the grass-roots courts as the research object. From the angle of the function of assistant judge, this paper discusses the system of assistant judge in basic court. At present, the purpose of the pilot judge assistant system in China is to solve the shortage of judges at the grass-roots level and to improve the efficiency of the trial. But in the actual operation, the effect is not obvious. Aiming at the mixed characteristics of the formal and informal justice of the grass-roots courts in our country, and the characteristics of the combination of non-specialization and gradual specialization of the judges at the grass-roots level. Pilot judges' assistants in the grass-roots courts are entrusted with the function of resolving the separation of formal and informal justice in the grass-roots courts. In order to gradually realize the professionalization of the courts and judges in our country, this paper examines the experience of the extra-territorial grass-roots court assistant system such as the United States, Germany, Japan, and the Taiwan area of our country. Referring to the implementation and operation of the assistant system of judges in these areas, combined with the characteristics of the basic courts and judges in our country, this paper puts forward the diversification of the management mode of the assistant judges of the basic courts. At the same time, some basic court judges are given the right of litigation mediation, so as to realize the separation of formality and informality.
