【摘要】：法治社会下的任何权力都必须接受监督和制约。当前,我国正朝着社会主义法治国家不断迈进,因此国家权力必须接受监督和制约。我国的检察权是宪法赋予的法律监督权,由检察机关依法独立行使,与其他国家相比,其在行使过程中有很大的不同,一方面,检察权在行使中因监督制约而导致检察权独立性缺乏保障；另一方面,检察权又因监督制约的缺失导致权力的滥用。司法实践中检察权的监督制约机制还存在不健全、不完善、不落实等问题。因此,构建合理的检察权监督制约机制对于我国的司法改革,甚至法治进程具有重大而深远的意义。本文在充分认识我国检察权的基础上,就检察权现行的外部和内部监督制约机制进行分析,指出其存在的问题,并就如何健全和完善检察权的监督制约机制进行研究,为我国检察权监督制约机制的完善提出相关建议。本文共分为四部分：第一章检察权的起源,本章通过分析比较两大法系——大陆法系和英美法系及以苏联为首的社会主义法系国家检察制度的产生过程,论证检察权产生的历史必然性。第二章我国检察权的定位分析,本章侧重理论分析,通过阐述我国检察制度的产生和发展过程,分析检察权的概念及内容,对我国的检察权进行理性定位。第三章检察权监督制约的价值分析,本章从三个方面分析了作为一种法律监督权的检察权,对其进行监督制约的必要性,为下文我国检察权的监督制约机制的分析搭建理论平台。第四章我国检察权的监督制约机制的完善,本章第一节从权力制约和权利制约两个角度出发,分析了现行的检察权外部监督制约机制,针对存在的问题,提出了相关建议,以便构建完善的检察权外部监督制约机制。第二节从横向监督制约和纵向监督制约及强化检察队伍的素质方面着手,对现行检察权的内部监督制约机制进行评析,并提出相关完善建议,以期加快建设社会主义法治国家的进程。
[Abstract]:Any power under the rule of law society must be subject to supervision and restriction. At present, our country is moving towards a socialist country ruled by law, so the state power must be supervised and restricted. Compared with other countries, the procuratorial organs exercise their procuratorial power independently according to law. On the one hand, the exercise of procuratorial power leads to the lack of guarantee of the independence of procuratorial power because of supervision and restriction; on the other hand, The lack of supervision and restriction leads to the abuse of power. In judicial practice, the supervision and restriction mechanism of procuratorial power is still imperfect, imperfect, and not implemented. It is of great and far-reaching significance to construct a reasonable supervision and restriction mechanism of procuratorial power for the judicial reform and even the process of ruling by law in our country. This paper analyzes the existing external and internal supervision and restriction mechanism of procuratorial power, points out its existing problems, and studies how to perfect and perfect the supervision and restriction mechanism of procuratorial power. To improve the supervision and restriction mechanism of procuratorial power in China. The third chapter analyzes the value of supervision and restriction of procuratorial power. This chapter analyzes the necessity of supervision and restriction of procuratorial power as a kind of legal supervisory power from three aspects. The first section of this chapter sets out from two angles of power restriction and power restriction, which is the improvement of supervision and restriction mechanism of procuratorial power in China in the 4th chapter, which is based on the analysis of supervision and restriction mechanism of procuratorial power in China. This paper analyzes the existing external supervision and restriction mechanism of procuratorial power, and puts forward some relevant suggestions in view of the existing problems. In order to build a perfect external supervision and restriction mechanism of procuratorial power. The second section analyzes the internal supervision and restriction mechanism of the current procuratorial power from the aspects of horizontal and vertical supervision and restriction and strengthening the quality of the procuratorial team. And puts forward the related consummation suggestion, in order to speed up the construction socialism rule of law country's progress.
