检察机关职务犯罪侦查“检警一体化”机制研究

【摘要】：司法警察作为人民检察院一支具有武装性质的司法力量和法定成员，具有享有侦查权的法理依据、现实基础和拓展空间，在构建“检警一体化”机制方面并无障碍，推行这一机制在促进职务犯罪侦查工作公正高效、推进司法警察队伍的职业发展等方面意义重大。放眼长远，立足现实，，在遵循现行法律框架的条件下，合理划分决策层面与执行层面的侦查事务，司法警察以编队的形式整体参加侦查办案工作，并逐步拓展侦查职能范围，自主、能动、创造性地完成以执行层面为主的侦查事务，是实现检察机关侦查效能最大化和体现司法警察职能属性的有效途径。检察机关具备行使侦查权的合理性，司法警察具备成为职务犯罪侦查主体的必要性、理论依据和现实可能性，随着司法体制改革的全面推进，特别是刑诉法修改后，对检察机关司法警察的组织建制、队伍素质和专业化水平的要求更高，司法警察的职责任务调整势在必行。如何在职务犯罪侦查活动中形成良好的“检警一体化”机制，既有效整合检察机关内部的办案资源，又充分调动司法警察“依法参与检察活动”的积极性，发挥司法警察独有的职能作用，提高办案效率和办案质量是一个颇具现实和长远意义的问题。在积极探索实践“检警一体化”机制过程中，要积极推进机制的保障建设，防止出现重回检警不分、削弱编队管理、忽略办案安全的弊端。
[Abstract]:As an armed judicial force and legal member of the people's Procuratorate, the judicial police have the legal basis, realistic basis and expanding space to enjoy the power of investigation, and there is no obstacle in constructing the mechanism of "procuratorial and police integration". The implementation of this mechanism is of great significance in promoting justice and efficiency in the investigation of job-related crimes and in promoting the professional development of the judicial police force. The judicial police participate in the investigation work in the form of formation, and gradually expand the scope of the investigation function, autonomous, active and creative to complete the investigation affairs, which is mainly on the executive level, in the form of rational division of the investigation affairs at the decision-making level and the executive level, and gradually expand the scope of the investigation functions. It is an effective way to maximize the investigation efficiency of procuratorial organs and embody the functional attributes of judicial police. The procuratorial organs have the rationality of exercising the investigation power, and the judicial police have the necessity to become the subject of investigation of duty crimes. With the promotion of the reform of the judicial system, especially after the revision of the Criminal procedure Law, the theoretical basis and the realistic possibility require the judicial police of procuratorial organs to have a higher level of organization, quality and specialization. It is imperative to adjust the duties and tasks of judicial police. How to form a good "procuratorial and police integration" mechanism in the investigation of job-related crimes, which is not only an effective integration of the internal procuratorial organs' case handling resources, And fully mobilize the enthusiasm of the judicial police to "participate in procuratorial activities according to law" and give play to the unique function of the judicial police, To improve the efficiency and quality of handling cases is a realistic and long-term problem. In the process of actively exploring and practicing the mechanism of "procuratorate and police integration", we should actively promote the safeguard and construction of the mechanism so as to prevent the occurrence of returning to the procuratorial and police departments without distinction. Weaken the formation management, ignore the malpractice of handling the case safety.
