和谐社会视域下的司法公正

【摘要】：司法公正是现代社会追求的价值目标和最基本的行为准则,也是和谐社会最主要的、最基本的特征之一。随着我国改革开放的深入,司法公正方面的问题越来越突出,而这些问题得不到公正合理的解决,就会严重影响社会的和谐,后果是不可设想的,必将造成一系列的社会问题,影响建立一个安定有序、稳定的社会。改革开放以来中国各方面的进步比较快,司法公正方面的问题也日益凸出,亟待关注和解决。在构建社会主义和谐社会的时代背景下,研究和谐社会视野下的司法公正问题具有重要的理论意义同时也具有实践意义。从理论意义来看,它将有助于深化我们对司法公正与社会主义和谐社会基本理论的认识,从而丰富和完善我们对司法公正的重要性的认识；从现实意义来看,它将有助于妥善解决我国当前社会中存在的各种不公正问题,通过公正的司法来解决各种纠纷。为建设和谐社会要遵守“司法公正要一心为民“的要求,遵循司法的客观规律性,努力增强司法的严格性、司法的公正性、司法的文明性、司法的高效能力。当代中国正在谋求构建社会主义和谐社会,司法公正是社会和谐的首要价值、重要目标及重要手段。没有司法公正就没有社会主义和谐社会。公平正义是社会主义和谐社会的重要特征之一、是社会和谐最基本的条件。因此,在司法活动中要努力做到合法性与合理性统一,同时,也要做到实体公正与程序公正并重,公正与效率兼顾,最终实现法律效果与社会效果的统一。司法机关作为解决纠纷的专门机关,通过司法的公正性,保障社会公正,促进和谐社会构建。论文由绪论、正文及结束语三个部分组成。绪论(第一章)简要阐述了问题的提出与选题意义,国内外研究现状,以及研究问题的方法。正文共分四章。第二章主要是对和谐社会进行系统的阐述分析,探讨了社会主义和谐社会的内涵,以及社会主义和谐社会的六个基本特征；第三章阐述了司法公正基本理论。首先阐明了司法公正的含义,包括公正的含义和司法公正的含义,其次论述了司法公正的构成要素及司法公正的意义：第四章着重进行司法公正的价值分析。此章首先论证了司法公正的工具性价值,其中主要包括司法公正是实体公正与程序公正的统一和司法公正对和谐社会的促进作用。其次是司法公正的实质性价值,主要内容包括是司法公正要以人为本的重要性、维护司法廉洁保障司法公正以及司法公正是实现法治的保障等等；第五章主要阐述了司法公正对和谐社会的功能分析,这一部分首先分析了司法公正是构建和谐社会的基础和保障,其次撰写了司法公正是和谐社会的关键与核心价值,最后讲述了司法公正对和谐社会的意义。结束语是对全文的总结,再次强调司法公正对构建社会主义和谐社会的重要性和和谐社会是司法公正的最终目的和归宿点。
[Abstract]:Judicial justice is the value goal and the most basic code of conduct pursued by modern society, and it is also one of the most important and basic characteristics of harmonious society. With the deepening of reform and opening up in China, the problems of judicial justice become more and more prominent. And if these problems are not solved fairly and reasonably, they will seriously affect social harmony. The consequences are unthinkable, which will inevitably cause a series of social problems and affect the establishment of a stable and orderly society. A stable society. Since the reform and opening up, China has made rapid progress in all aspects, and the problems in judicial justice have become increasingly prominent, and need to be paid close attention to and solved urgently. Under the background of constructing a harmonious socialist society, It is of great theoretical and practical significance to study the issue of judicial justice from the perspective of harmonious society. From the theoretical point of view, it will help us to deepen our understanding of the basic theory of judicial justice and socialist harmonious society. In order to enrich and improve our understanding of the importance of judicial justice; from a practical point of view, it will contribute to the proper solution of the various unjust problems existing in our current society, In order to build a harmonious society, we must abide by the requirement of "judicial justice must be single-minded for the people", follow the objective regularity of the judicature, strive to enhance the strictness of the judicature, the impartiality of the judicature, and the civilization of the judicature. Modern China is seeking to build a harmonious socialist society, judicial justice is the primary value of social harmony, There is no socialist harmonious society without judicial justice. Fairness and justice is one of the important characteristics of socialist harmonious society and the most basic condition of social harmony. In judicial activities, we should strive to achieve the unity of legitimacy and rationality, at the same time, we should pay equal attention to substantive justice and procedural justice, and give consideration to both justice and efficiency. Finally, the unity of the legal effect and the social effect is realized. As a specialized agency for resolving disputes, the judicial organ ensures the social justice and promotes the construction of a harmonious society through the judicial impartiality. This paper is composed of three parts: introduction, text and conclusion. The introduction (chapter 1) briefly expounds the significance of the question and the significance of the topic, and the current research situation at home and abroad. The second chapter mainly expounds and analyzes the harmonious society systematically, discusses the connotation of the socialist harmonious society and six basic characteristics of the socialist harmonious society; The third chapter expounds the basic theory of judicial justice. Firstly, it clarifies the meaning of judicial justice, including the meaning of justice and the meaning of judicial justice. Secondly, it discusses the elements of judicial justice and the significance of judicial justice: chapter 4th focuses on the value analysis of judicial justice. This chapter first demonstrates the instrumental value of judicial justice. Judicial justice is the unity of substantive justice and procedural justice and the promotion of judicial justice to a harmonious society. Secondly, the substantive value of judicial justice, including the importance of putting people first in judicial justice, is the main content. The 5th chapter mainly expounds the function analysis of judicial justice to harmonious society, such as safeguarding judicial integrity and judicial justice, and judicial justice is the guarantee to realize the rule of law, etc. This part first analyzes that judicial justice is the foundation and guarantee of building a harmonious society, and then writes that judicial justice is the key and core value of a harmonious society. The conclusion is a summary of the full text, emphasizing again the importance of judicial justice to the construction of socialist harmonious society and the harmonious society is the ultimate goal and destination of judicial justice.
