论我国涉诉信访制度的改革与完善

【摘要】：涉诉信访是目前困扰法院工作,影响社会稳定的一大难题,近年来,无论是理论界还是实务界都对涉诉信访制度尝试进行改革,以期使其逐渐走入良性循环的轨道之中。但涉诉信访的形势却更加严重,信访要求常常超出司法范畴,信访的方法和手段也日趋激烈和极端,涉诉信访陷入了“信访洪峰”的困境。本文期望通过对涉诉信访制度进行法社会学的分析,使我们对涉诉信访制度的历史、现状和未来有更为客观的认识,通过对涉诉信访制度在当代社会的现实运行及其去留两难困境的关照,使我们对社会整体性问题有所洞察,最后提出改革完善建议,希望对涉诉信访问题的解决有所裨益。
[Abstract]:Complaint petition is a difficult problem that puzzles the work of the court and affects social stability. In recent years, both theoretical and practical circles have attempted to reform the petition system. In order to make it gradually enter into the orbit of virtuous circle, but the situation concerning complaint, petition and visit is more serious, the request for petition often goes beyond the scope of judicature, and the methods and means of petition are becoming increasingly fierce and extreme. The author hopes to make us have a more objective understanding of the history, present situation and future of the complaint petition system through the analysis of legal sociology. Through the consideration of the practical operation of the petition system in the contemporary society and the dilemma of whether to stay or not, we have some insight into the whole problem of the society, and finally put forward some suggestions for reform and perfection, hoping to be of benefit to the solution of the problem.
