【摘要】：正权利自始与保护紧密相联,"无保护则无权利"的法律格言强调保护对于权利实现的重要作用。司法保护是弱势群体权益在公法上的最有效的保护环节和最终保障。一、弱势群体权益司法保护的必要性在法治国家,弱势群体的权利必须通过司法保护,是由司法这一公权力的功能和属性决定的。司法具有补偿、恢复和保护权利的功能。在权利运行体系上,立法分配权利,行政保护权利免受侵害,司法则在权利受到侵害时以补偿、恢复的方式来保护。弱势群体的多样性和弱势群体权益的多
