以受援人为核心的法律援助制度研究

【摘要】：现代世界各国的宪法和其他法律普遍规定了人权,但在实际生活中,法律上的权利平等与实现生活中所享有的权利平等往往会因经济条件上的不同而不同。为了使法律形式上的平等成为现实生活中实际意义上的平等,国家就必须得为贫困者提供法律援助以保障其合法权益,构建以受援人为核心的法律援助制度则是实现贫困者权利的最佳选择。文章从界定法律援助的概念入手,在比较两大法系国家有关法律援助的规定和在深入分析我国法律援助制度主要问题的基础上,论证了在我国构建以受援人为核心的法律援助制度的现实意义和紧迫性,最后对如何构建以受援人为核心的法律援助制度提出了自己的设想。本文包括五个部分：第一部分首先阐述了国内外关于法律援助的概念,然后说明其存在的社会价值,最后通过说明受援人在法律援助中的地位来揭示法律援助的精神实质。第二部分是对两大法系主要国家的法律援助制度的介绍,通过对英、美、德、法四国法律援助制度的比较分析,总结出法律援助制度建立和发展的一般规律,从而为我国借鉴其成功经验作好理论上的铺垫。第三部分通过对我国法律援助制度的历史考察以及现状分析,指明我国法律援助制度中所存在的问题。主要包括：法律援助立法滞后、法律援助管理混乱、受援人权利意识淡薄。第四部分通过东西方法律援助制度的对比,指出了我国构建以受援人为核心的法律援助制度的必要性。第五部分是对构建我国以受援人为核心的法律援助制度的设想：在以人为本的指导思想下,从我国法律援助立法体系的完善、明确受援人在法律援助中的权利和法律援助机构职能的重构三个方面提出了具体的解决方案。
[Abstract]:Human rights are generally enshrined in the constitutions and other laws of the modern world, but in real life, The equality of legal rights and the realization of equality of rights in life are often different from each other in terms of economic conditions. In order to make equality in the form of the law equal in the practical sense of real life, The state must provide legal aid to the poor in order to protect their legal rights and interests, and the construction of a legal aid system with recipients as the core is the best choice to realize the rights of the poor. This paper begins with the definition of legal aid, compares the provisions of legal aid in the two legal system countries, and analyzes the main problems of our legal aid system in depth. This paper demonstrates the practical significance and urgency of constructing the legal aid system with the recipients as the core in our country, and finally puts forward some ideas on how to construct the legal aid system with the recipients as the core. This article consists of five parts:. The first part first expounds the concept of legal aid at home and abroad, then explains the social value of its existence, and finally reveals the spiritual essence of legal aid by explaining the status of the recipient in legal aid. The second part is the introduction of the legal aid system in the main countries of the two legal systems. Through the comparative analysis of the legal aid systems of Britain, the United States, Germany and France, the general law of the establishment and development of the legal aid system is summarized. Thus for our country to learn from its successful experience to prepare a theoretical foundation. The third part points out the problems existing in the legal aid system of our country through the historical investigation and the analysis of the present situation of the legal aid system of our country, mainly including: the legal aid legislation lags behind, the legal aid management is confused, The right consciousness of the recipient is weak. The 4th part points out the necessity of constructing the legal aid system with recipients as the core through the comparison of the legal aid systems between the East and the West. The 5th part is to construct the legal aid system with the recipient as the core of our country: under the guiding ideology of people-oriented, from the consummation of the legal aid legislation system of our country, Specific solutions are put forward to clarify the rights of recipients in legal aid and the reconstruction of the functions of legal aid institutions.
