论我国刑罚执行检察监督的完善

【摘要】：本文主要采取与先进国家对比的方法，说明我国刑罚执行的检察监督还有欠缺的地方，特别是与指挥型检察监督的国家相比，我国还有很多需要借鉴的地方。纵观国际局势，一共有三种类型的刑罚执行检察监督，它们是制约型检察监督、督察型检察监督和指挥型检察监督。第一种检察监督的好处在于效率高，但是要花费很大的人力和物力，，并且存在着自己监督自己的弊端；第二种检察监督相对第一种检察监督，它不必花费那么多的人力和物力，但是却存在着监督滞后的弊病；第三种检察监督，它是第一种检察监督和第二种检察监督的合体，既能节省人力和物力又能起到全面监督的作用。第三种检察监督在发达国家较为普遍适用，我国现在的检察监督类型属于第二种检察监督，我国需要向发达国家借鉴，完善我国的刑罚执行检察监督制度。本文分为四大部分。本文的第一大部分主要内容为我国刑罚执行法律监督的诉讼意义，包括三个部分：第一，防止司法不公，贪赃枉法，保障受刑人人权，维护安定秩序；第二，保障刑罚目的的最终实现；第三，促使刑罚政策更符合国情。本文的第二大部分是关于对国外刑罚执行检察监督的考察与借鉴，包括国外刑罚执行检察监督的考察；对国外刑罚执行监督的借鉴。本文第三大部分是关于我国刑罚执行检察监督的现状与问题，主要包括监禁刑执行检察监督的不足；非监禁刑执行检察监督的不足与死刑执行检察监督的不足和财产刑执行检察监督的不足。本文的第四大部分，是关于完善我国刑罚执行检察监督的内容，主要包括完善监禁刑执行检察监督，完善非监禁刑执行检察监督和完善死刑执行检察监督和财产刑执行检察监督。
[Abstract]:This paper mainly adopts the method of comparing with the advanced countries, and explains that there are still some deficiencies in the procuratorial supervision of the execution of penalty in our country, especially compared with the countries with command type of procuratorial supervision, our country still has a lot to learn from the international situation. There are three types of procuratorial supervision on the execution of penalties. They are restricted procuratorial supervision, procuratorial supervision based on supervision, and procuratorial supervision based on command. The advantage of the first type of procuratorial supervision lies in its high efficiency, but it costs a great deal of manpower and material resources. The second kind of procuratorial supervision is relative to the first kind of procuratorial supervision, which does not have to spend so much manpower and material resources, but it has the disadvantage of lagging behind in supervision; the third kind of procuratorial supervision, It is the combination of the first kind of procuratorial supervision and the second kind of procuratorial supervision, which can save manpower and material resources as well as play the role of overall supervision. The third kind of procuratorial supervision is generally applicable in developed countries. The type of procuratorial supervision in our country now belongs to the second type of procuratorial supervision. We need to learn from the developed countries and perfect the procuratorial supervision system of penalty execution in our country. This article is divided into four parts. The first part of the main content of this paper is the significance of the legal supervision of the execution of punishment in China, including three parts: first, to prevent judicial injustice, corrupt and perverted the law, to protect the human rights of prisoners, and to maintain stability and order; The second part of this paper is about the investigation and reference of the procuratorial supervision of the execution of foreign penalty, including the inspection of the procuratorial supervision of the execution of foreign penalty. The third part of this paper is about the current situation and problems of the procuratorial supervision of penalty execution in our country, mainly including the deficiency of the procuratorial supervision of the execution of imprisonment punishment; The deficiency of procuratorial supervision of execution of non-custodial punishment, the insufficiency of procuratorial supervision of execution of death penalty and the insufficiency of procuratorial supervision of execution of property penalty. The majority of 4th of this paper is about perfecting the content of procuratorial supervision of execution of penalty in our country. It mainly includes perfecting the procuratorial supervision of the execution of imprisonment penalty, the procuratorial supervision of execution of non-custodial punishment and the procuratorial supervision of execution of death penalty and execution of property penalty.
