法庭论辩中批判性问题评估法之应用

【摘要】：批判与质疑在消除争议方面起着关键性作用,法庭论辩作为一种动态性、交互性的争议解决机制,应被置于批判性讨论框架之中予以审视、检省。批判性问题评估法作为与批判性讨论相匹配的评估机制,注重辩证评估整个论证的过程,并在该过程中识别出论证效力的例外情形予以排除或反驳,以达到加固或削弱论证的目的。在法庭论辩语境中,审判方、起诉方、应诉方在遵循实体和程序规则的前提下,围绕法律规范的不完备性与案件事实的不确定性提出批判性问题,在批判与回应的对话剖面中检验各种诉讼主张,逐一排除合理性怀疑,最终实现论证结论的可接受性。
[Abstract]:Criticism and doubt play a key role in resolving disputes. As a kind of dynamic and interactive dispute resolution mechanism, court debate should be examined in the framework of critical discussion. As an evaluation mechanism matching with the critical discussion, the critical problem evaluation method pays attention to the process of dialectical evaluation of the whole argumentation, and in this process, the exception of identifying the validity of the argumentation is excluded or refuted. In order to reinforce or weaken the argument. In the context of a court argument, the judge, the prosecution, and the respondent follow the rules of substance and procedure, Based on the imperfections of the legal norms and the uncertainty of the facts of the case, this paper puts forward critical questions, tests all kinds of litigation claims in the dialogue section of criticism and response, removes the doubt of rationality one by one, and finally realizes the acceptability of the argumentation conclusion.
