新时期我国人民调解制度的发展及完善

【摘要】：被誉为“东方之花”的人民调解制度,作为我国一种重要的诉讼外纠纷解决机制,长期以来在化解社会矛盾与冲突、促进社会的和谐与稳定方面发挥着不可替代的作用。随着改革开放的不断深化,西方主流法治思想对我国传统的争端解决方式产生极大的冲击,特别是对我国人民调解制度带来了前所未有的挑战。由于社会转型期社会矛盾日益繁杂,如何重新审视人民调解的性质及法律定位,重构以人民调解为中心的ADR,成为一项重大的理论课题和现实问题。本文将以人民调解为中心,对其理论基础、当前困境及发展进路进行深入分析,最后结合新出台的《人民调解法》谈其在贯彻落实中应注意的问题,并据此提出完善人民调解的设想。
[Abstract]:The people's mediation system, known as "the flower of the east", as an important mechanism for resolving disputes outside litigation in China, has been resolving social contradictions and conflicts for a long time. The promotion of social harmony and stability plays an irreplaceable role. With the deepening of reform and opening up, the western mainstream thought of the rule of law has a great impact on the traditional dispute settlement in China. In particular, it has brought unprecedented challenges to the people's mediation system in our country. Because of the increasingly complicated social contradictions in the period of social transformation, how to re-examine the nature and legal orientation of people's mediation, The reconstruction of ADRs centered on people's mediation has become an important theoretical and practical issue. This paper will take people's mediation as the center and make a thorough analysis of its theoretical basis, current predicament and development path. Finally, the paper discusses the problems that should be paid attention to in the implementation of the new people's Mediation Law, and puts forward the idea of perfecting the people's mediation.
