G省初任检察官遴选方案设计

【摘要】:检察官担负着检控犯罪、对司法机关的执法司法活动进行法律监督,维护社会公平正义的重任,这要求检察官的必须具备很高的法律素养和职业操守。初任检察官遴选制度决定了检察官的准入门槛和方式,即如何选拔素质最优者进入到检察官队伍中来,是检察官遴选制度中最重要的一环。这一遴选方案设计的科学与否直接关系到检察官个体素质的高低和整个检察队伍履行职权的能力以及其监督职能发挥的效果。 鉴于G省现行初任检察官遴选方案存在将检察官遴选与公务员选拔混同,没有针对检察官职业特点设计相关选拔方法、选拔程序等不足,我们有必要对其进行重新设计,改革原有的检察官遴选模式,建立适合G省省情和检察职业特点的初任检察官遴选方案。本文拟以G省检察系统正在酝酿的检察官遴选机制改革为研究对象,在充分结合G省政治、经济、社会、文化、人才储备等情况的基础上,针对检察官职业特点,运用人力资源管理的相关理论尤其是素质特征理论,积极借鉴国外检察官遴选方案和其他人才遴选方案的先进经验,结合G省检察官遴选方案发展的实际,从重构检察官准入制度入手,对改革G省初任检察官遴选制度提出建议和初步方案构想,从完善遴选架构、扩大遴选范围、规范遴选程序等方面入手,设计包括遴选机关、选拔人员范围和条件、报名和资格审查、考试内容和方法,改革考察和体检、培训与实习、录用审批以及监督检查等环节在内的一整套选拔方案,以充分利用社会法律人才资源,为检察官队伍补充高素质人才提供源头活水,进而推动司法改革进程。 本研究不但有利于丰富检察官遴选研究理论的相关内容,,有利于为G省初任检察官遴选方案改革提供理论依据,对其他地区重新设计检察官遴选方案也有着积极的参考价值。
[Abstract]:Prosecutors are charged with the task of prosecuting crimes, carrying out legal supervision over the judicial activities of the judicial organs, and safeguarding social fairness and justice. This requires that prosecutors must have a high degree of legal literacy and professional integrity. The selection system for first-time prosecutors determines the threshold and manner of admission for prosecutors, that is, how to select the best qualified people to enter the ranks of prosecutors. The scientific design of this selection scheme is directly related to the individual quality of the procurator, the ability of the whole procuratorial team to perform its functions and powers, and the effect of its supervisory function. In view of the shortcomings of the current selection scheme for newly appointed prosecutors in Province G, which mixes the selection of prosecutors with the selection of civil servants, and does not design relevant selection methods and selection procedures according to the professional characteristics of prosecutors, it is necessary for us to redesign them. This paper intends to study the reform of procurator selection mechanism which is brewing in the procuratorial system of province G, and to establish a new scheme for the selection of procurators suitable to the situation of province G and the characteristics of procuratorial profession. On the basis of fully combining the politics, economy, society, culture, talent reserve and so on in G province, and aiming at the professional characteristics of procurators, the relevant theories of human resources management, especially the theory of quality characteristics, are applied. Drawing on the advanced experience of foreign procurator selection schemes and other talent selection schemes, and combining the development of procurator selection schemes in Province G, this paper begins with the reconstruction of the admission system of prosecutors. This paper puts forward some suggestions and preliminary plans for reforming the selection system of the initial public procurators in Province G, starting from the aspects of perfecting the selection structure, expanding the selection scope, standardizing the selection procedure, and so on. The design includes the selection organ, the scope and the conditions of the selection. Registration and qualification examination, examination contents and methods, reform of inspection and physical examination, training and practice, employment examination and approval, supervision and inspection, etc., in order to make full use of social and legal talent resources, To provide a source of fresh water for the procurator team to supplement high-quality talents, and then to promote the process of judicial reform. This study is not only helpful to enrich the relevant contents of the theory of procurator selection, but also to provide the theoretical basis for the reform of the selection scheme of initial public procurators in province G, and also has positive reference value to redesign the selection scheme of prosecutors in other regions.
