【摘要】：在新一轮司法体制改革中,司法责任制被喻为“牛鼻子”,其重要性不言而喻。司法责任制的落实尤其关涉司法机关的权力配置、司法人员的权力责任与当事人的合法权益。本文从司法责任制的渊源入手,得出检察官司法责任追究制度的含义和特点。阐释古今中外司法文明传统、人民主权原则和权责一致原则、权力制约和司法监督三者是构建检察官司法责任追究制度的理论基础。构建该制度有助于健全社会主义法治体系,加强社会主义法制权威,有助于实现司法公正,有助于提高检察队伍建设水平与检察人员业务素质,对新一轮司法体制改革有巨大的推动作用。同时,通过对主要国家和地区检察官惩戒制度的考察、评析,希冀我国在学习先进法治理念与制度设计后,结合本国检察工作的实际,设计出更加合理的检察官司法责任追究制度。当前,党中央对依法治国理念的积极倡导,频繁曝光的冤假错案导致司法公信力降低,司法公正的社会需求极度上升以及继往开来的司法体制改革,为我国构建检察官司法责任追究制度提供了非常有利的时代背景和社会条件。高检院顺应时代和改革的要求出台相关文件,对检察官司法责任追究制度进行了概括式设计。相关文件既有进步之处,也有不足之处。鉴于当前我国并未形成统一完善的检察官司法责任追究制度,各项配套制度尚未发挥出其应有的作用。根据检察工作的实际,提出构建检察官司法责任追究制的指导原则,从制定司法责任追究的专门法律、建立专门且独立的司法责任追究机构、完善司法责任追究的程序、加强检察队伍建设,提高检察官业务素质水平、加强案件的档案管理,做好干预司法处理的登记工作、加强检察职业保障,建立检察人员豁免制度六个方面对构建该制度提出完善建议。
[Abstract]:In the new round of judicial system reform, judicial responsibility system is called "ox nose", and its importance is self-evident.The implementation of judicial responsibility system is especially concerned with the distribution of power of judicial organs, the power and responsibility of judicial personnel and the legitimate rights and interests of the parties.Starting from the origin of judicial responsibility system, this paper draws the meaning and characteristics of procurator's judicial responsibility system.It is the theoretical basis of constructing procurator's judicial responsibility system to explain the tradition of judicial civilization, the principle of people's sovereignty and the principle of consistency of power and responsibility, the restriction of power and judicial supervision.The construction of this system is helpful to improve the socialist legal system, strengthen the authority of socialist legal system, realize judicial justice, improve the level of procuratorial team construction and improve the professional quality of procuratorial personnel.To a new round of judicial system reform has the huge impetus function.At the same time, through the investigation of the disciplinary system of public procurators in major countries and regions, it is hoped that after studying the advanced concept of the rule of law and the design of the system, our country will combine the reality of procuratorial work in our own country.To design a more reasonable system of judicial accountability of prosecutors.At present, the CPC Central Committee has actively advocated the idea of governing the country according to law, and the frequent exposure of unjust and false cases has led to a decrease in judicial credibility, a rise in the social demand for judicial justice, and the reform of the judicial system that carries on the past.It provides a very favorable background and social conditions for the construction of procurator's judicial responsibility investigation system in our country.According to the times and the requirements of reform, the Supreme people's Procuratorate issued relevant documents, and designed the system of investigating the judicial responsibility of procurators in a general way.The relevant documents have both progress and shortcomings.In view of the fact that our country has not formed a unified and perfect system for investigating the judicial responsibility of prosecutors, the supporting systems have not yet played their due role.According to the actual situation of procuratorial work, this paper puts forward the guiding principle of establishing the system of investigating the judicial responsibility of public procurators, from making the special law on the investigation of judicial responsibility, establishing a special and independent institution for investigating judicial responsibility, and perfecting the procedure of investigating judicial responsibility.Strengthening the construction of procuratorial teams, improving the professional quality of procurators, strengthening the file management of cases, doing a good job of intervening in the registration of judicial processing, strengthening procuratorial professional security,The establishment of procuratorial immunity system in six aspects of the establishment of the system to improve the proposal.
