民事检察调查核实权探究

【摘要】：新《民事诉讼法》对调查核实权的规定仅有一条，还需要检察机关在实践中不断稳步探索，完善调查核实权的操作规范，提升民事检察监督的效果。然而，所有的探索都必须符合职权法定的基本原则，严格遵守我国现有的立法规定，坚持客观公正和依法调查原则，促使民事检察调查核实权运用的合理化，防止和制止权力的无限扩张和滥用，确保民事检察监督在法治的轨道上运行。第一章是民事检察调查核实权之概念导入。先是立足于新《民事诉讼法》的法条规定，对民事检察调查核实权行权目的、行权阶段进行分析，得出民事检察调查核实权的概念，再将其与相似概念进行辨析。第二章分析民事检察调查核实权之权力属性。从上层概念民事检察权入手，剖析其性质，，经由其核心权力即抗诉权、检察建议权的分析，指明民事检察调查核实权法律监督权的本质属性，同时也是实现民事检察监督的配套保障。第三章进行民事检察调查核实权之立法沿革与全新探索。首先介绍民事检察调查核实权确立前理论实务界论及最多的“调查取证权存废之争”，然后通过整理调查核实权在法律层面予以确立的立法轨迹，以及新《民事诉讼法》修订草案对此规定的前后对比，得出民事检察调查核实权在立法上是妥协之后的折中之策。第四章是设立民事检察调查核实权之正当性分析。该项权力的设立的确有其正当性及合理性，既是回应实务需要，也符合理论期待。同时，通过美国、法国、前苏联以及俄罗斯四个代表国立法规定的域外考察，亦能发现民事检察监督中调查权的踪影。第五章阐述民事检察调查核实权之实务运行原则与完善设想。第一部分，指明民事检察调查核实权运行应当以谦抑审慎为原则。第二部分是在当下有关民事检察调查核实权规定的基础上，分别从权力的硬件实力与软件保障两方面提出进一步完善的期待。
[Abstract]:The new Code of Civil procedure has only one provision on the right of investigation and verification, which requires the procuratorial organs to explore steadily in practice, to perfect the operational norms of the power of investigation and verification, and to enhance the effect of civil procuratorial supervision.However, all explorations must conform to the basic principles of power and power, strictly abide by the existing legislative provisions of our country, adhere to the principles of objectivity, impartiality and investigation according to law, and promote the rationalization of the application of the right of verification of civil procuratorial investigations.To prevent and stop the unlimited expansion and abuse of power and to ensure that civil procuratorial supervision runs on the track of rule of law.The first chapter is the introduction of the concept of the right of civil procuratorial investigation and verification.First, based on the provisions of the new Civil procedure Law, this paper analyzes the purpose and stage of the exercise of the right of civil procuratorial investigation and verification, and obtains the concept of the right of civil procuratorial investigation and verification, and then differentiates it from the similar concept.The second chapter analyzes the power attribute of the civil procuratorial investigation verification right.Starting with the upper concept of civil procuratorial power, this paper analyzes its nature. Through the analysis of its core power, that is, the right of protest and the right of procuratorial suggestion, it points out the essential attribute of the right of legal supervision of the right of civil procuratorial investigation and verification.At the same time, it is also the necessary guarantee to realize the civil procuratorial supervision.The third chapter carries on the legislation evolution and the brand-new exploration of the civil procuratorial investigation verification right.First of all, it introduces the theory and practice circle of civil procuratorial investigation before the establishment of the right to verify the most of the "dispute over the right to investigate and collect evidence", and then through sorting out the legal level of the right of investigation and verification to establish the legislative track,Compared with the new draft of Civil procedure Law, it is concluded that the right of civil procuratorial investigation and verification is a compromise in legislation.Chapter four analyzes the legitimacy of establishing the right of civil procuratorial investigation verification.The establishment of the power has its legitimacy and rationality, which not only responds to the practical needs, but also meets the theoretical expectations.At the same time, through the legislation of the four representative states of the United States, France, the former Soviet Union and Russia, we can also find the trace of the investigation power in the civil procuratorial supervision.The fifth chapter elaborates the practical operation principle and perfect assumption of the civil procuratorial investigation verification right.In the first part, the author points out that the operation of the power of civil procuratorial investigation and verification should be based on modesty and prudence.The second part is based on the current provisions of the civil procuratorial investigation and verification power, respectively from the power of hardware strength and software protection two aspects of further improvement of expectations.
