能动司法的法理分析

【摘要】：自“能动司法”理念被中国法院高层极力倡导以来,该主张被认为是我国司法的基本理念和基本方式。但是,法学界乃至司法实务界对此的争议就一直不断。有些学者认为,能动司法是西方司法能动主义的中国化,能动司法有助于调解日益严重的社会矛盾,解决社会纠纷;也有些学者认为,能动司法不具有正当性,完全背离了我国司法克制的这种传统司法,容易造成法院职能的缺位、越位和错位,并进一步认为中国的法治进程在倒退。笔者认为,中国正处于社会转型的关键时期,随着经济社会的发展进步,结合中国的具体国情,适度调整一个时期的司法理念,未尝不可。相反,这正是中国司法发展的体现。能动司法不是司法能动主义在中国的简单移植,两者之间既有联系又有区别。从古代司法传统以及现代司法需求来看,能动司法在中国社会有其存在的依据,具有正当性。作为一个全新的司法理念,能动司法在中国的运行必须要遵守一定的原则,例如能动司法不能违背立法规律,能动司法必须在宪法和法律范围内运行以及能动司法必须维护法律价值。本文拟通过对能动司法的法理分析,从能动司法的内涵及正当性入手,考证能动司法在中国存在的依据,进而着重探讨其应该遵守的一些原则。选题的目的在于通过能动司法的法理分析,阐明能动司法与司法规律、合法性以及法律价值之间的关系,希望借此对能动司法有一个规制,进而防止法院在行使司法权的过程可能出现的权力滥用现象。由于学界乃至司法实务界对能动司法的研究较少,固通过本文的分析,笔者相信有助于学界和司法实务界认识到该问题的重要性和紧迫性,从而对该问题进行更为深入的研究,把能动司法落实好,更好的促进我国司法的发展。
[Abstract]:Since the concept of "active justice" was strongly advocated by the high level of Chinese courts, it has been regarded as the basic concept and method of our country's judicature.However, legal circles and even the judicial practice of this controversy has been constantly.Some scholars believe that active justice is the Chinese character of western judicial activism, and that active justice helps to mediate the increasingly serious social contradictions and solve social disputes.This kind of traditional judicature, which completely deviates from the judicial restraint in our country, can easily lead to the absence, offside and dislocation of the function of the court, and further thinks that the process of the rule of law in China is retrogressive.The author believes that China is in the critical period of social transformation, with the development of economic and social progress, combined with the specific conditions of China, moderate adjustment of the judicial concept of a period, it is not impossible.On the contrary, this is the embodiment of China's judicial development.Active justice is not a simple transplant of judicial activism in China.From the view of ancient judicial tradition and modern judicial demand, active judicature has its existence basis and legitimacy in Chinese society.As a completely new judicial concept, active justice in China must follow certain principles. For example, active justice cannot violate the law of legislation.The active justice must operate within the scope of constitution and law, and the active justice must maintain the legal value.By analyzing the legal principle of active judicature, this paper starts with the connotation and legitimacy of active judicature, and explores the basis of the existence of active judicature in China, and then probes into some principles it should abide by.The purpose of this paper is to clarify the relationship between active judicature and judicial law, legitimacy and legal value through the legal theory analysis of active judicature, hoping to have a regulation on active judicature.And then prevent the abuse of power that the court may appear in the process of exercising judicial power.Since there are few researches on active justice in academic circles and judicial practice circles, through the analysis of this paper, the author believes that it is helpful for scholars and judicial practice circles to realize the importance and urgency of this problem, so as to carry out more in-depth research on this issue.Carry out the active judicature well, promote the development of our country's judicature better.
