我国远程审判的现状及完善

【摘要】：信息技术的飞速发展和广泛应用,已经、正在并将继续影响人类社会的变革。信息化建设已经被我国政府提升到了战略举措的高度,大力发展信息化必将成为国家现代化建设的重要方向。人民法院,作为现代社会的重要环,也必然会受到信息化的深刻影响。近年来,随着人口流动性不断增强,案件数量的增长使诉讼机制的功能性障碍日益凸显,法院不堪重负,当事人权益不能及时实现,使得人民法院加快了信息化建设步伐,出现了通过网络视频远程审判的新型审判方式。远程审判方式是一种将科技融入诉讼,采用视频、声音、图像于一体的,能够使当事人在不同的审理地点同步参加审判活动的新型审判模式,具有效率高、节约司法成本,便于保护当事人的权益等优势,同时也为审判带来了不少难题,诸如法院如何对当事人的身份认证、证据如何认证与质证等。同时,由于远程审判方式过分依赖于科技,因此,信息技术与人员素质也是制约远程审判方式全面推广的因素。应当说明的是,远程审判方式在性质上是传统审判方式的补充和延伸,并非是一种独立的新的审判方式。目前,我国对远程审判方式的研究还处于初级阶段,研究多数存在于理论方面,诸如远程审判方式的概念、特点、意义等,对于远程审判方式制度构建的研究还不多见。随着我国法院局域网系统的不断完善,各地法院对远程审判方式也在进行积极地实践,甚至有不少法院的成功经验为完善远程审判方式提供了范本。但是,要全面推广远程审判方式,还需要完善相关制度规范和加强信息技术和人才建设,以便在实现远程审判方式的功能的同时,减少不必要的诉讼障碍,进一步增强远程审判方式的可行性。
[Abstract]:The rapid development and wide application of information technology has, is and will continue to influence the transformation of human society.Informatization construction has been promoted to the level of strategic measures by our government, and vigorously developing informatization will become an important direction of national modernization.The people's court, as an important ring of modern society, is bound to be deeply influenced by information technology.In recent years, with the increasing mobility of the population and the increase in the number of cases, the functional obstacles of the litigation mechanism become increasingly prominent, the courts are overwhelmed, and the rights and interests of the parties cannot be realized in time, which makes the people's courts speed up the pace of information construction.There has been a new type of trial through the network video remote trial.Remote trial is a new type of trial mode, which integrates science and technology into litigation, adopts video, sound and image, and enables the parties to participate in trial activities simultaneously in different trial places. It has high efficiency and saves judicial costs.It is convenient to protect the rights and interests of the parties, but also brings a lot of difficulties to the trial, such as how the court authenticates the parties, how to authenticate the evidence and cross-examination, and so on.At the same time, the remote trial mode is too dependent on science and technology, so the information technology and the personnel quality are also the factors that restrict the comprehensive popularization of the remote trial mode.It should be pointed out that the remote trial is a supplement and extension of the traditional trial in nature, and is not an independent new trial.At present, the research of remote trial in our country is still in the primary stage, most of the research exists in theory, such as the concept, characteristics and significance of remote trial, and the research on the construction of remote trial system is still rare.With the continuous improvement of the local area network (LAN) system of the courts in our country, the courts around the country are also actively practicing the remote trial mode, and even many successful experiences of the courts have provided a model for the perfection of the remote trial mode.However, in order to promote the remote trial mode in an all-round way, it is also necessary to improve the relevant systems and norms and strengthen the information technology and talent building in order to achieve the functions of the remote trial mode while reducing unnecessary obstacles to litigation,Further enhance the feasibility of remote trial.
