论高校教育管理纠纷的ADR解决

【摘要】:高校教育管理纠纷,是高校教育管理发展过程中,逐渐呈现出来的问题。伴随着高校规模的扩大与大学教育的普及,有关高校教育管理纠纷问题也日益增多。随着教育的不断深化和社会对教育领域的不断重视,高校教育管理纠纷的解决已经成为了社会各界广泛研讨的热点问题。而在不断的理论基础挖掘与实践活动验证中,通过ADR模式来解决不断出现的高校教育管理纠纷问题,也已逐渐成为大家所认同的解决问题的方式。 由于高校在社会中相对特殊的独特地位,使得其出现的问题很难通过简单的司法审查来得到妥善的处理,其中包含的法律关系,不只是民法范畴,还有行政范畴。因此,单纯的通过诉讼来界定责任,解决问题常常难以奏效。但是随着问题的不断增加和扩大,如何在当下解决好这一高校发展过程中存在的重要问题,已经是迫在眉睫。究其根源,是因为现有的司法审查制度过于繁杂且不够完善,不能很好地解决新时代背景下出现的问题与纠纷。同时由于行政的干预和法律地位的不确定,也使得现今高校教育管理纠纷解决出现了种种困境。而ADR模式的出现,为合理解决高校教育管理纠纷,开辟了一条全新的道路。 ADR,即替代性纠纷解决方式(Alternative Dispute Resolution),是指不经过司法裁判,而由中立的第三方来参与解决纠纷的方式。相比于诉讼制度的程序繁琐,花费高昂,ADR模式在程序上更加简约灵活,花费的人力物力也相对诉讼制度要减少很多,对目前司法审判中的“诉讼爆炸”现象有着很好的缓解与分流作用。同时,相对于一般纠纷诉讼,高校的纠纷诉讼以其具有的独特性,复杂性,令受案范围变得难以界定,同时诉讼的时间与步骤都相应变得冗长。而用ADR模式来解决高校纠纷问题,却显得更加的游刃有余。ADR灵活的方式,独有的特性和优势,定会令其在解决高校管理教育纠纷中,占据很重要的位置。 ADR的概念,虽然是近现代才提出的一个全新概念,但是这种解决纠纷的思想,古已有之。中国早在春秋时期,就有“不诉”的思想流传。而从古至今,中国人的观念仍然是“多一事不如少一事”,“县官不如现管”这样的不诉理念。而到了近现代,这种理念,已经转变为了一种全新的理念,是对国家权力与公民权利的一种重新的诠释,更是对司法行为的补充与完善。各种不同形式的ADR模式,对于各个领域的司法活动,都是一个极其有力的助手。 通过ADR模式的多种渠道,衍生了许多解决高校教育管理纠纷的方式方法。例如协商机制、调解机制、仲裁机制、申诉机制等。这些非诉讼的方式,不仅在时间上更简便,花费上更简约,处理问题也是更加的高效快捷。比起动辄一年半载甚至更长时间的马拉松式的诉讼程序,越来越多地受到社会广泛的关注与青睐。 全文内容由以下几个部分组成: 开篇是文章的引言,简要地阐述了本文的研究背景与现实意义,文章结构和框架。 第一章对当今高校的教育管理纠纷进行了界定,对纠纷的性质进行了分析,区分了高校纠纷的类别,为梳理弄清高校教育管理纠纷,奠定了理论基础。 第二章分析了高校教育管理纠纷解决的困境及其内在原因,突出探究了现实困境的严重程度,以及其中蕴含的深刻原因,提出了现实问题。这些是寻找解决方式的重要基础。 第三章重点介绍了ADR模式的理论与实践基础。描述了ADR模式在解决高校教育管理纠纷的可行性与适用性,并且与国外的理论相比较对照,找出适合我国高校教育管理纠纷的ADR解决途径,从而更好的解决高校教育管理纠纷问题。 第四章提出了高校教育管理纠纷的ADR解决的具体途径。包括ADR的各种解决原则,具体措施。最终通过此种途径,可以更快、更好地解决高校教育管理纠纷的种种问题。 最后是文章的结语部分,对全文进行了简要的总结并给出了相关的结论。
[Abstract]:With the expansion of university scale and the popularization of university education, the problem of disputes in the management of higher education is increasing. With the deepening of education and the constant attention of the society to the field of education, the settlement of disputes in the management of higher education. It has become a hot topic in all circles of society, and in the continuous verification of theoretical foundation mining and practical activities, it has gradually become the way to solve the problem by ADR mode to solve the problems of college education management disputes.
Because of the special special status of the University in the society, it makes it difficult to solve the problem by simple judicial review. The legal relationship contains not only the civil law category, but also the administrative category. Therefore, it is often difficult to solve the problem through the purely litigation. But it is difficult to solve the problem. But with the problem, it is difficult to solve the problem. Increasing and expanding, how to solve the important problems in the process of the development of the university is imminent. The reason is that the existing judicial review system is too complex and imperfect, and can not solve the problems and disputes in the new era. At the same time, because of administrative intervention and law, it is difficult to solve the problems and disputes in the new era. The uncertainty of the position has also made various difficulties in solving the disputes in the education management in Colleges and universities. The emergence of the ADR model has opened up a new road for the rational solution of the disputes in the management of higher education.
ADR, the alternative dispute resolution (Alternative Dispute Resolution) means the way to settle disputes by neutral third parties without judicial refereeing. It is more complicated and expensive than the procedure of the litigation system. The ADR model is more simple and flexible in the program, and the cost of manpower and material resources is also a lot less than the litigation system. At present, the phenomenon of "litigation explosion" in judicial trial has a very good relief and diversion. At the same time, relative to the general dispute litigation, the dispute litigation in Colleges and universities is unique and complex, which makes the scope of the case difficult to define. At the same time, the time and steps of the litigation have become lengthy. And the ADR mode is used to solve the University correction. A lot of problems, but a more flexible way of.ADR, unique characteristics and advantages, will make it occupy a very important position in solving the dispute of university management and education.
Although the concept of ADR is a new concept in modern times, the idea of settling disputes has been established in ancient times. As early as the spring and Autumn period, the idea of "no prosecution" was circulated in the spring and Autumn period. From ancient times to the present, the idea of the Chinese people is still "less than one thing and less one thing" and "county officials are not as good as now". In modern times, this concept has been transformed into a new concept, a reinterpretation of state power and civil rights, and a supplement and improvement of judicial behavior. The various forms of ADR model are a very powerful assistant to judicial activities in various fields.
Through various channels of the ADR model, many ways and means to solve the disputes of educational management in Colleges and universities are derived. Such as negotiation mechanism, mediation mechanism, arbitration mechanism, complaint mechanism, etc. these non litigation methods are not only more convenient in time, more concise, and more efficient and faster in handling problems. The long marathon procedure has been widely concerned and favored by the society.

The opening part is the introduction of the article, and briefly describes the research background and practical significance of this article, the structure and framework of the article.
The first chapter defines the disputes of education management in Colleges and universities, analyzes the nature of the disputes, distinguishes the categories of the disputes in Colleges and universities, and lays a theoretical foundation for combing and clearing up the disputes of educational management in Colleges and universities.
The second chapter analyzes the difficulties and internal causes of the dispute settlement of the university education management, and explores the seriousness of the realistic predicament, and the profound reasons in it, and puts forward the practical problems. These are the important bases for finding the solution.
The third chapter mainly introduces the theoretical and practical basis of ADR model, describes the feasibility and applicability of ADR mode in solving the dispute of educational management in Colleges and universities, and compares it with foreign theories, and finds out the ADR solution suitable for the dispute of educational management in our universities and colleges, so as to better solve the problem of the dispute of educational management in Colleges and universities.
The fourth chapter puts forward the specific ways to solve the dispute of educational management in Colleges and universities, including the solving principles of ADR, and the concrete measures. Finally, through this way, we can solve all kinds of problems of higher education management disputes faster and better through this way.
The last part is the conclusion of the article, which summarizes the whole article and gives the relevant conclusions.
