【摘要】：调解制度是陕甘宁边区法制建设的有机组成部分,通过民间调解、群众团体调解、政府调解、司法调解等几种主要调解形式的运用,不仅有效地为当事人排纷解难,为政府节约了宝贵的司法资源,而且为人民调解制度的建设提供了借鉴经验。在现代社会,随着政治、经济、文化事业的发展,在人民群众内部不可避免地出现一些新的矛盾和纠纷。调解制度在现代作为解决民事纠纷的一种主要方式,仍然发挥着重要的作用。因此,本文对陕甘宁边区的调解制度做了全方位的探究,并提出了一些有关陕甘宁边区调解制度值得现代借鉴之处。陕甘宁边区,作为国民政府所属特殊行政区域和中共中央所在地,这一时期对调解制度的研究是一个值得重视的历史现象,且具有其特殊性。首先对陕甘宁边区调解制度进行了全面解读,探讨了边区调解制度的社会背景及其理论基础,并指出其精髓和历史价值。继而针对边区调解法规进行了对比分析,通过分析揭示了调解法规在边区的发展和完善。其次从调解制度的史料入手,详细分析了调解制度的主要类型,并结合传统调解习俗运用具体案例对当时调解制度进行了实证考察。这一时期受社会现状的影响,调解制度在当时发挥了很重要的作用。当前,我国正处于改革的攻坚期同时也是社会矛盾的多发期,探索多元化的民事纠纷解决机制为构建和谐社会起了重要的推动作用。
[Abstract]:The mediation system is an organic part of the legal system construction in the Shensi-Kansu-Ningxia Border region. The use of several major forms of mediation, such as folk mediation, mass group mediation, government mediation and judicial mediation, not only effectively solves the difficulties for the parties concerned, It saves precious judicial resources for the government, and provides reference experience for the construction of the people's mediation system. In modern society, with the development of politics, economy and culture, some new contradictions and disputes inevitably appear among the people. Mediation system still plays an important role as a main way to solve civil disputes in modern times. Therefore, this paper makes a comprehensive study of the mediation system in the Shensi-Kansu-Ningsia Border region, and puts forward some references to the mediation system in the Shensi-Kansu-Ningsia Border region. As a special administrative region belonging to the national government and the seat of the CPC Central Committee, the Shensi-Kansu-Ningsia Border region was a historical phenomenon worthy of attention during this period, and had its particularity. Firstly, the mediation system in the Shensi-Kansu-Ningsia Border region is comprehensively interpreted, the social background and theoretical basis of the mediation system in the Border region are discussed, and the essence and historical value of the mediation system are pointed out. Then, the paper makes a comparative analysis on the border mediation laws and reveals the development and perfection of the mediation laws in the border area. Secondly, starting from the historical data of mediation system, this paper analyzes the main types of mediation system in detail, and makes an empirical study of mediation system at that time by using specific cases of traditional mediation customs. In this period, affected by the social situation, the mediation system played a very important role at that time. At present, our country is in the critical period of reform, and it is also a period of social contradictions. Exploring the diversified mechanism of civil dispute resolution plays an important role in building a harmonious society.
