我国司法行政化问题检视

【摘要】：司法行政化是一个困扰了我国法治进程多年的问题,其形成有着深刻的历史与现实原因,是一个超出了单纯法学领域的社会问题。司法行政化不是我国现代化司法进程中出现的特有问题,但是这个问题在我国显示出了严重性,对司法公正、司法效率、司法公信力,乃至审判人员的素质都产生了严重的负面影响,是我国建立现代化司法制度必须要解决的问题。解决司法行政化问题必须根据社会物质生产能力、社会文化的发展水平等因素的改变,积极的、有策略的、通过有规划的长期改革才能实现。司法行政化问题能否被妥善的逐步解决,关乎我国能否最终实现依法治国。司法行政化问题的解决,将成为我国实现司法独立,发展社会主义法治的关键。
[Abstract]:Judicial administration is a problem that has troubled the process of rule of law in our country for many years. Its formation has profound historical and realistic reasons, and it is a social problem beyond the field of pure law. The administration of justice is not a unique problem in the process of modern justice in our country, but this problem has shown the seriousness of judicial justice, judicial efficiency and judicial credibility in our country. Even the quality of judges has a serious negative impact, which must be solved in the establishment of modern judicial system. To solve the problem of judicial administration, we must change the factors such as social material production capacity and the level of development of social culture, which can be realized through long-term planned reform. Whether the problem of administration of justice can be solved step by step is related to whether our country can finally realize the rule of law. The solution to the problem of judicial administration will become the key to the realization of judicial independence and the development of socialist rule of law.
