构建我国法官法律信仰的制度环境问题研究

【摘要】：法律信仰的是伴随着法治社会的兴起而产生的,它是考量一个社会法治进程的重要尺度。法律共同体是法律信仰的载体,因此法律信仰的产生和坚守都离不开法律共同体。本文试图以构成法律共同体的重要部分法官为主要考察对象,通过分析法官法律信仰的形成的制度基础、历史演进过程以及当前法官法律信仰制度环境缺失的现实背景,以梳理出当下法治社会建设过程中法官的法律信仰缺失对于法治社会建设带来的负面影响,以及导致我国法官法律信仰及其制度环境缺失的成因。通过对于法官法律信仰制度环境缺失在法律观念层面上和法律制度层面上的成因分析,本文试图以法治观念上的建构和法律制度上的建构两个大方面对法官法律信仰缺失问题提出一种具有参考意义的制度性保障,以促进法官法律信仰的形成,以期能为我国社会主义法治建设做出有益探索。
[Abstract]:Legal belief comes into being with the rise of a society ruled by law, which is an important yardstick to consider the process of ruling by law in a society. Legal community is the carrier of legal belief, so the emergence and adherence of legal belief can not be separated from legal community. This paper attempts to analyze the institutional basis of the formation of the judges' legal beliefs, the historical evolution process and the realistic background of the absence of the current environment of the judges' legal beliefs, taking an important part of the judges in the legal community as the main object of investigation. In order to sort out the lack of legal belief of judges in the process of the construction of a society under the rule of law in order to bring about the negative impact on the construction of a society ruled by law, as well as the causes of the lack of the legal beliefs of judges and their institutional environment. Through the analysis of the causes of the lack of the legal belief system environment in the legal concept level and the legal system level, In order to promote the formation of judges' legal belief, this paper attempts to put forward a kind of institutional guarantee with reference to the lack of legal belief of judges from two aspects: the construction of the concept of the rule of law and the construction of the legal system. In order to make a beneficial exploration for the construction of socialist rule of law in our country.
