论《人民调解法》的完善

【摘要】:人民调解制度是一项具有深厚中华民族传统的法律制度,是化解社会矛盾、消除纷争的非诉讼解决方式,是现代社会自治的必然要求,是法治发展的促进力量,是利益实现的理性选择。《人民调解法》的颁布实施是人民调解工作发展史上的一件大事,是人民调解制度发展的一座里程碑,对于提升人民调解工作法律地位,完善中国特色社会主义法律体系,实现人民调解工作法制化、制度化、规范化,及时化解民间纠纷,维护社会和谐稳定具有非常重要的意义。 但由于《人民调解法》是首次以法律形式对人民调解这一具有中国特色制度进行规范调整,从实施一年的情况来看,还存在很多不足,人民调解基本原则表述模糊,没有体现依法的原则;人民调解委员会的设置遗漏了居民小区,设立人民调解委员会应当要备案,人民调解委员会的任期三年时间太短,在基层反响较大,不利基层工作的稳定性和连续性;人民调解工作程序方面也有很多不足,在调解中,邀请有关人员参与调解需征得当事人同意的规定欠妥,对调解代表人没有规定,在调解方式中只要求自愿,而没有明确规定了解纠纷基本事实,明确当事人是非责任不妥;人民调解协议的性质没有明确,对调解协议申请司法确认的申请主体要求十分严苛,对申请期限、管辖法院、审查期限、审查收费等方面没有明确规定;人民调解法没有对人民调解前置进行规范;对人民调解工作的指导遗漏了乡镇人民政府的指导,而基层人民法院对人民调解业务指导规定又过于原则,不易操作,应当细化;人民调解工作经费保障方面责任不明确。 本文针对《人民调解法》中基本原则、调解委员会的设置、调解工作程序、人民调解协议、人民调解前置、人民调解工作的指导、经费保障等方面存在的不足进行了认真分析,并对这几个方面提出了完善的建议,以期推动人民调解工作的不断发展。
[Abstract]:The people's mediation system is a legal system with profound tradition of the Chinese nation, a non-litigation solution to resolve social contradictions and disputes, an inevitable requirement of modern social autonomy, and a force to promote the development of the rule of law. The promulgation and implementation of the people's Mediation Law is a major event in the history of the development of people's mediation and a milestone in the development of the people's mediation system. It is of great significance to perfect the legal system of socialism with Chinese characteristics, to realize the legalization, institutionalization and standardization of people's mediation, to resolve civil disputes in time, and to maintain social harmony and stability. However, since the people's Mediation Law is the first time that the people's mediation system with Chinese characteristics has been standardized and adjusted in the form of law, there are still many deficiencies in the implementation of the law, and the basic principles of people's mediation are expressed vaguely. The establishment of the people's Mediation Committee has omitted the residential areas, the establishment of the people's Mediation Committee should be put on record, and the term of office of the people's Mediation Committee is too short and has a strong response at the grass-roots level. The stability and continuity of work at the grass-roots level are unfavourable; there are also many deficiencies in the procedures of the people's mediation. In mediation, it is inappropriate to ask the consent of the parties to participate in the mediation by inviting the relevant personnel to participate in the mediation, and there is no provision for the mediation representative. In the way of mediation, only voluntary is required, but there is no clear provision to understand the basic facts of the dispute, and it is clear that the parties are not properly responsible; the nature of the people's mediation agreement is not clear, and the requirements of the subject of the application for judicial confirmation of the mediation agreement are very strict. There is no clear stipulation on the application period, the jurisdiction of the court, the examination period, the examination of fees, etc.; the people's Mediation Law does not regulate the people's mediation; and the guidance for the people's mediation work omits the guidance of the township people's government. The basic people's court has too much principle to guide the people's mediation, which is not easy to operate, and should be refined; the responsibility of the people's mediation fund guarantee is not clear. Based on the basic principles of the people's Mediation Law, the setting up of the mediation committee, the procedure of mediation, the agreement of the people's mediation, the leading position of the people's mediation, the guidance of the people's mediation work, the guarantee of funds and so on, this paper makes a serious analysis. In order to promote the continuous development of the people's mediation work, this paper puts forward some perfect suggestions on these aspects.
