【摘要】：律师协会是律师行业的自律管理组织。自1993年有关部门首次明确提出司法行政管理与协会行业自律管理的“两结合”律师管理模式以来,律师协会积极发挥行业自律管理功能,为律师行业发展起到了积极的作用。但随着近年来律师行业快速发展和律师队伍不断壮大,对自律管理的要求也持续提高。律师协会在维护会员权益、管理行业准入、规范执业行为等方面的不足日益凸显。律师协会的社会公信力不足、律师行业缺乏社会认同等问题开始逐渐制约其发展。完善律师协会自律管理功能的必要性和迫切性正与日俱增。社团组织的发展动态一直是公共管理学的一个关注焦点。我国律师协会作为一个极具中国特色的社会团体法人,其发展、完善具有丰富的研究价值。本文围绕完善扬州市律师协会行业自律管理功能这一主题,通过文献比较法、实证分析法等研究方法,以扬州市律师协会作为考察对象,从理论和实践两个层面对扬州市律师协会行业自律管理中存在的问题与不足进行调查研究。同时针对存在的问题,综合分析内、外部因素,借鉴国外经验做法,对协会的组织架构、自律管理规范、内控机制、会员沟通和引导等方面提出建设性意见。论文主要分为四个部分:第一部分:绪论。阐述了本文的选题背景及研究意义、文献综述、研究方法、以及本文的创新点和不足。第二部分:理论基础。在回顾我国律师协会行业自律管理功能的历史沿革基础上,对其当代内涵进行界定;对我国律师管理“两结合”模式和这一模式对律师协会行业自律管理功能的影响作简要分析,为本文的研究提供理论基础。第三部分:现状研究。通过对扬州市律师协会管理人员、会员的分别访谈和查阅大量工作资料,全面分析协会在自律管理实践中的成效、不足。第四部分:探索对策。从内、外因两个方面,对完善协会行业自律管理功能的可行性与必要性进行归纳,并借鉴国外先进经验,提出可行的对策:包括组织结构、管理规范、内控机制、会员沟通、组织引导等几个方面。最后,结论部分对全文的研究观点作最终总结,并提出相关后续研究的主要方向。
[Abstract]:The Bar Association is a self-regulatory organization in the law profession. Since 1993, when the relevant departments first put forward the "two combined" lawyer management mode of judicial administration and association industry self-discipline management, the Bar Association has played an active role in the development of the lawyer profession by giving full play to the self-discipline management function of the profession. However, with the rapid development of the lawyer industry in recent years and the continuous expansion of lawyers, the requirements of self-discipline management continue to improve. The Bar Association has become increasingly deficient in safeguarding the rights and interests of its members, managing industry access and standardizing its practice. The lack of public credibility of the Bar Association and the lack of social identity of the lawyer profession began to restrict its development. The necessity and urgency of perfecting the self-discipline management function of the Bar Association are increasing day by day. The development of community organization has been a focus of public management. As a social legal person with Chinese characteristics, Chinese Bar Association has rich research value in its development and perfection. Based on the theme of perfecting the self-discipline management function of Yangzhou Bar Association, this paper takes Yangzhou Bar Association as the object of investigation through the methods of literature comparison and empirical analysis. This paper investigates and studies the problems and deficiencies in the profession self-discipline management of Yangzhou Bar Association from the two aspects of theory and practice. At the same time, this paper comprehensively analyzes the internal and external factors, draws lessons from foreign experience and practices, and puts forward constructive suggestions on the organization structure, self-discipline management standard, internal control mechanism, member communication and guidance of the association. The thesis is divided into four parts: the first part: introduction. The background and significance of this paper, literature review, research methods, as well as the innovative points and shortcomings of this paper are described. The second part: theoretical basis. On the basis of reviewing the history of the self-discipline management function of China's Bar Association, this paper defines its contemporary connotation. This paper makes a brief analysis of the mode of "two combinations" of lawyer management in our country and its influence on the self-discipline management function of the bar association, which provides a theoretical basis for the study of this paper. The third part: the present situation research. Through the interviews with the managers and members of the Yangzhou Bar Association and the reference to a large number of working materials, this paper comprehensively analyzes the effectiveness of the association in the practice of self-discipline management, which is insufficient. The fourth part: explore the countermeasure. From two aspects of internal and external causes, this paper sums up the feasibility and necessity of perfecting the self-discipline management function of the association industry, and draws lessons from the advanced experience of foreign countries and puts forward feasible countermeasures: including organizational structure, management standard, internal control mechanism, member communication, etc. Organizational guidance, etc. Finally, the conclusion makes the final summary of the research views and puts forward the main directions of the related follow-up research.
