新闻舆论监督对公正审判的促进作用

【摘要】：新闻舆论监督作为社会监督的一种重要形式,对公正审判具有积极的促进作用,其监督作用的发挥具有重要的理论和现实意义。虽然不当的新闻舆论监督会给审判工作和司法权威带来一定的负面影响和干扰,但这些负面影响和干扰都是可以控制的。如果因为监督所带来的一定干扰而抵制甚至封杀新闻舆论监督,这却是不可取的,关键是应如何限制它的负面作用而充分发挥它的正面作用。虽然从表面上看好像是不当的新闻舆论监督影响了法院的公正审判,但从根本上说,法院所受到的人事、经济、政治等方面的制约,以及法院现有的审判组织设置,法官个人素质,匮乏健康的司法文化等才是导致法院不当裁判的根本原因。新闻舆论监督和公正审判之间在本质上是统一的,合理的新闻舆论监督有助于促进公正审判的顺利进行。本论文旨在通过分析新闻舆论监督对公正审判的必要性、可行性以及在实施中的现有困境,从而构建起新闻舆论监督公正审判的良性机制,以进一步发挥新闻舆论监督对公正审判的促进作用。 第一章,分析新闻舆论监督与公正审判之间的一致性与差异性;第二章,在我国的司法环境下,分析新闻舆论对公正审判进行监督的必要性;第三章,分析开展新闻舆论监督的困境,主要包括对新闻舆论监督功能认识的错位,新闻舆论监督的受限性以及对舆论审判的误解;第四章,论述如何构建起一个新闻舆论监督公正审判的良性机制。
[Abstract]:As an important form of social supervision, news public opinion supervision plays a positive role in promoting fair trial, and its supervisory role has important theoretical and practical significance. Although improper supervision of news and public opinion will bring some negative influence and interference to judicial work and judicial authority, these negative influences and interference can be controlled. It is not advisable to resist or even block the supervision of news and public opinion because of the interference brought by supervision. The key is how to limit its negative effect and give full play to its positive role. Although it seems on the face of it that improper supervision of the news and public opinion has affected the fair trial of the court, fundamentally speaking, the court is subject to personnel, economic, political and other constraints, as well as the existing trial organization of the court. The judge's personal quality and the lack of healthy judicial culture are the root causes of the court's failure to adjudicate. The supervision of news public opinion and fair trial are United in essence, and reasonable supervision of public opinion is helpful to promote the smooth progress of fair trial. The purpose of this paper is to construct a benign mechanism for the supervision of public opinion by analyzing the necessity, feasibility and existing difficulties in the implementation of public opinion supervision on a fair trial. In order to further play the role of media supervision to promote fair trial. The first chapter analyzes the consistency and difference between the supervision of news public opinion and the fair trial; the second chapter, under the judicial environment of our country, analyzes the necessity of the news public opinion to supervise the fair trial; the third chapter, Analysis of the plight of public opinion supervision, including the mismatch of the function of the news public opinion supervision, the limitation of the news public opinion supervision and the misunderstanding of the public opinion trial; chapter four, This paper discusses how to construct a benign mechanism for the supervision of fair trial by news and public opinion.
