【摘要】：改革发展期、社会转型期，一般也是社会矛盾凸显、刑事案件高发期，监狱是社会高烧病症的“体温计”、社会衍生矛盾的“漏斗”，监狱服刑人员犯罪基本情况一定程度上折射出社会政治、经济、发展和治安状况。吉首监狱关押着湘西自治州八县市的刑事犯罪人员，是湘西地区唯一的一所监狱，它的服刑人员状况也就反映了湘西少数民族地区犯罪现状和特点。湘西少数民族地区因经济、社会环境、传统文化、风俗习惯等因素的差异，体现出独特的犯罪状况与特点，相应地实现对湘西少数民族地区犯罪的预防和控制也必须因特征、规律和原因而拟定相应的对策。对其研究不仅能够实现对湘西少数民族地区犯罪的有效预防和控制，维护社会的稳定和发展，把加快经济发展同保持政治社会稳定、加强民族团结结合起来；而且有助于吉首监狱制定切实有效的教育挽救措施，在把握湘西少数民族服刑人员心理特征的前提下因人施教，，提高教育改造质量，改造好民族罪犯，维护监管场所的稳定。通过对湘西少数民族地区服刑人员犯罪情况的调查，从犯罪主体、类型、区域和重新犯罪率四个方面分析了其特点，它与其它地区的犯罪存在诸多不同之处，犯罪类型、犯罪手段方法上，集中在侵犯人身权利犯罪、传统侵财型犯罪、受风俗习惯及宗教迷信引起的犯罪较为常见，黑恶势力犯罪有所增加，犯罪手段方法上，暴力方法较常使用，智能性低。在摸清犯罪特点的基础上，从湘西地区经济、法律、文化、心理特征、社会环境方面来探求犯罪原因，提出预防和减少犯罪的对策，推进湘西少数民族地区的稳定和发展。
[Abstract]:During the period of reform and development, social transformation period, social contradictions are also highlighted, criminal cases are high, prison is the "thermometer" of high fever in society, and the "funnel" of social contradictions. To a certain extent, the basic criminal situation of prison inmates reflects the social political, economic, development and public security situation. The Jishou prison is the only prison in western Hunan, which holds criminal personnel in eight counties and cities of Xiangxi Autonomous Prefecture. The status of its prisoners reflects the present situation and characteristics of crimes in Xiangxi ethnic minority areas. Due to the differences in economy, social environment, traditional culture, customs and other factors, the minority areas in western Hunan reflect their unique crime situation and characteristics. Accordingly, the prevention and control of crimes in the minority areas of western Hunan must also be attributed to their characteristics. The rules and reasons for the formulation of the corresponding countermeasures. The research on it can not only realize the effective prevention and control of crime in western Hunan minority areas, maintain social stability and development, but also combine accelerating economic development with maintaining political and social stability and strengthening national unity. Moreover, it is helpful for Jishou prison to formulate effective educational rescue measures, to teach people under the premise of grasping the psychological characteristics of the prisoners in western Hunan, to improve the quality of education reform, to reform the national criminals, and to maintain the stability of the supervising places. Through the investigation of the crime situation of the prisoners in the western Hunan ethnic minority area, this paper analyzes its characteristics from four aspects: the subject, the type, the region and the re-crime rate. There are many differences between the crime and other regions, the type of the crime. The methods of crime are concentrated in the crime of infringing personal rights, the traditional crime of invading property, the common crime caused by customs and customs and religious superstition, the increase of crimes committed by criminal and evil forces, and the more frequent use of methods of crime and methods of violence. On the basis of finding out the characteristics of crime, this paper probes into the causes of crime from the aspects of economy, law, culture, psychology and social environment in western Hunan, puts forward countermeasures to prevent and reduce crime, and promotes the stability and development of minority areas in western Hunan.
