监狱体制改革背景下山东省D监狱罪犯管理创新研究

【摘要】：山东省D监狱作为山东省监狱系统一个以煤炭能源为监狱企业支柱的,以煤炭生产衍生劳动岗位为监狱罪犯劳动改造提供岗位的监狱,目前正面临着监狱布局调整,监狱体制改革,监狱退危的多重考验。本文立足于此大背景下的山东省D监狱罪犯管理工作实际,通过对近几年山东省D监狱罪犯管理工作的调查研究,综合调查问卷、访谈、查阅数据等方法,运用公共管理学、公共治理理论、监狱学等方面的理论知识,从罪犯管理的职能法规、罪犯管理的手段以及罪犯管理的主体三大方面入手,选取监狱职能、罪犯狱政改造、劳动改造、教育改造、监狱警察队伍建设等角度对改革退危转型下山东省D监狱罪管理工作进行剖析研究,具体分析了监企合一的体制模式对监狱职能影响,以煤矿生产为主的劳动改造模式对罪犯的分类处遇制度的制约,监狱的退危转型搬迁对于罪犯的劳动改造目标的动摇,传统教育改造观念的持续根深蒂固,监狱警察队伍建设不够完善。针对问题的成因提出作者有的放矢基于协同治理角度从罪犯的管理职能法规方面提出要加快监狱改革推进步伐、完善立法,罪犯管理的手段方面提出要强化狱政改造职能建设、创新教育改造内容、打造科学的罪犯劳动改造体系、罪犯管理的主体方面要深化监狱人民警察队伍建设。这些建议的提出可以对提高监狱管理罪犯水平、强化罪犯改造、规范监狱警察执法、理顺监狱与其企业的关系、保障监狱警察和罪犯的合法权益具有一定的指导意义,同时,也可以为省内其他监狱的退危形势下的罪犯管理工作提供一定的借鉴。
[Abstract]:As a prison in Shandong Province, where coal energy is the mainstay of prison enterprises and jobs derived from coal production provide posts for prison criminals' re-education through labor, Shandong D prison is now facing a readjustment of the prison layout. Based on the actual situation of the criminal management in Shandong D prison under this background, this paper makes use of the methods of public management, such as investigation and research on the management of D prison criminals in Shandong Province in recent years, comprehensive investigation questionnaire, interview, data access and so on. Public governance theory, prison science and other theoretical knowledge, from the criminal management of the functional laws and regulations, the means of criminal management and criminal management of the main body of three major aspects of the selection of prison functions, prison reform, reform through labour, education reform, From the point of view of the construction of prison police force, this paper analyzes and studies the crime management work of D prison in Shandong Province under the transformation of reform and retreat, and concretely analyzes the influence of the system model of the integration of prison and enterprise on the prison function. The labor reform mode, which is based on coal mine production, restricts the classification and treatment of criminals, vacillates the target of reeducation through labour for criminals due to the transition and relocation of prisons, and the persistence of traditional education and reform concept. The construction of prison police force is not perfect enough. In view of the causes of the problem, the author puts forward that from the angle of cooperative governance, the author should accelerate the pace of prison reform, perfect the legislation, strengthen the construction of the prison administration reform function from the point of view of the criminal management function law, improve the legislation, and strengthen the construction of the prison administration reform function. We should innovate the contents of education and reform, create a scientific system of reforming criminals through labor, and deepen the construction of the prison people's police force in the main body of criminal management. These suggestions can improve the level of prison management criminals, strengthen the reform of criminals, standardize the law enforcement of prison police, straighten out the relationship between prisons and their enterprises, and protect the legitimate rights and interests of prison police and criminals. At the same time, It can also provide some reference for the management of criminals in other prisons in the province.
