S监狱服刑人员考核奖惩方法研究

【摘要】:监狱作为国家的刑罚执行机关,依据惩罚和改造相结合、教育和劳动相结合的原则,依法对罪犯实行执行刑罚,将罪犯改造成为守法公民。2008年中央政法委书记周永康同志指出“监管场所要把改造人放在第一位,要真正使他们痛改前非、重新做人,要把刑释解教人员重新违法犯罪率作为衡量监管工作的首要标准”。这给新时期的监狱工作提出了新的目标,要求监狱在完成好关押、看管服刑人员这一刑罚执行职能的同时,还要对服刑人员进行思想改造,,不断提升改造质量,使他们从根源上认罪服法、悔过自新,真正成为一名守法公民。做好对服刑人员的考核奖惩是完成这一工作目标的基础,因为一套良好的考核奖惩方法能保证服刑人员在思想和行为上保持长期稳定,能激励服刑人员的改造积极性,能促进服刑人员不断提升自身改造质量。本文着眼于新时期监狱工作目标,结合S监狱的发展现状,提出S监狱现行服刑人员考核奖惩方法在考核奖惩的方式、内容、地位、进程、权力分配、衔接协调等方面存在着问题,并分析了产生这些问题的原因。对S监狱服刑人员考核奖惩方法提出了优化建议,建议中引入了目标考核法、相关矩阵法等考核方式,将定量考核与定性考核有机的结合起来;依据马斯洛需求层次、双因素等经典理论,丰富了考核奖惩的内容,使考核奖惩更具针对性和激励约束作用;同时也对考核内容的权重,考核奖惩工作的程序提出了调整建议。使优化后的服刑人员考核奖惩方法能更好的为监狱工作、社会稳定提供重要保障。
[Abstract]:As the state's penal enforcement organ, prisons, in accordance with the principle of the combination of punishment and reform, education and labor, carry out the punishment of criminals in accordance with the law. In 2008, Comrade Zhou Yongkang, secretary of the Central Committee of political Science and Law, pointed out that "the place of supervision should put the reformed people at the top of the list, so that they can really change their minds and make a fresh start." We should take the crime rate of reentry of released prisoners as the primary standard of supervision. This has set a new goal for prison work in the new period, which requires prisons to carry out ideological reform and constantly improve the quality of prison inmates while completing the penal execution functions of the prisoners and guarding the prisoners. So that they confess to the root, repentant, truly a law-abiding citizen. To do a good job in assessing, rewarding and punishing prisoners is the basis for accomplishing this work goal, because a set of good assessment rewards and punishments can ensure the long-term stability of the prisoners in their thinking and behavior, and can stimulate the reform enthusiasm of the prisoners. Can promote the inmates to continuously improve their own transformation quality. Based on the aim of prison work in the new period and the present situation of S prison, this paper puts forward the methods of reward and punishment for the present prisoners in S prison, including the way, content, status, process and distribution of power. There are some problems in connection and coordination, and the causes of these problems are analyzed. This paper puts forward some optimized suggestions on the methods of reward and punishment for the evaluation of prisoners in S prison, including the introduction of objective assessment method, correlation matrix method and other assessment methods, which combine the quantitative assessment with qualitative assessment organically, according to Maslow's demand level, The classical theory of double factors enriches the contents of the examination rewards and punishments, makes the examination rewards and punishments more targeted and motivating and binding, and also puts forward some suggestions to adjust the weight of the examination contents and the procedure of the examination rewards and punishments. The optimized method of evaluation, reward and punishment can provide important guarantee for prison work and social stability.
