北京市监狱系统监管安全事件应对机制研究

【摘要】：监狱的安全稳定是监狱工作的基础,是监狱对罪犯实行惩罚和改造的前提,更是新时期监狱机关治理与构建社会主义和谐社会的首要职责。当前,在维护监狱的安全稳定的内外部条件、软硬件环境建设、技术装备和监管安全设施建设越来越好的现实条件下,监管安全事件依然是影响和制约着监狱安全稳定的一个重要因素。本文从组织管理机制的视角出发,将监狱监管安全事件的应对机制界定为监狱系统各管理主体和要素、以及监狱组织与外部环境之间相互关联、相互作用和相互耦合的过程、程序及制度,其目的在于优化监狱自身组织的运行和控制,实现各类管理资源的最优配置,达成对监管安全事件应对的最佳状态。本文以北京市监狱系统的监管安全事件应对实践为研究对象,在查阅和整理相关文献资料的基础上,从组织管理机制的视角对其进行了分析解读和概括提炼,按照监管安全事件的应对流程,提出了监管安全事件预防、应对准备、现场处置、事后恢复重建等方面的机制建设内容,所形成的主要观点和对策建议是: (1)监管安全事件的应对要实现由被动应付向主动应对、从结果导向到原因导向的发展,关键是坚持预防为主的原则,加强监管安全事件的预防,未雨绸缪地通过管理和技术手段控制不安全行为,消除事故隐患,保障监狱的安全。监狱的预防的重点是,加强不同戒备等级监狱(监区)的组织建设,加强监狱内部的侦查工作,严防各类违禁物品流入监狱,加强危险罪犯的管理控制等。 (2)监管安全事件是防不胜防的,要按照居安思危、防患于未然的理念,做好各方面的应对准备,在事件发生前准备好应对处置对策和相应的人、财、物方面的资源安排,努力做到“以不变应万变”,把可能造成的损失减少到最小限度。监狱的应对准备的重点是,应急队伍准备、突发事件预案建设、应急物资准备、警察队伍应对处置监管安全事件能力提升等。 (3)监管安全事件的应对处置是应对机制的核心环节,要根据事件的性质、特点和危害程度,及时组织相关部门,调动应急资源,对监管安全事件进行快速有效的处置,降低事件损失及可能造成的负面影响。监管安全事件处置的关键是速度,快速启动反应系统,果断指挥,及时协调。监狱在应对处置中需要重点注重的是应对处置环节、处置决策和事件信息的报送等方面。 (4)监管安全事件得到有效控制后,要迅速从以应对处置为主转变到以恢复重建为主,不仅要恢复事件造成影响的设施设备,实现监狱工作秩序的正常化,更要总结事件的经验教训,提升防范能力,整体提升监狱应对监管安全事件的水平。有鉴于此,加强事后的调查评估、客观公正地追究责任,加强恢复重建方面的工作是监狱此时工作的重中之重。本文将北京市监狱系统近年来监管安全事件的应对实践放置到全市监狱系统持续安全稳定的总体要求和大背景下进行具体分析和研究。案例研究表明,加强监管安全事件应对机制建设,强化干警直接管理和狱情排查工作,不断提升防范和化解问题、矛盾与风险的能力,最大限度地降低监管安全事件的发生频率和危害程度,是全面实现北京市监狱系统持续安全稳定的工作基础和机制保障。监管安全事件的应对机制研究是对监狱安全管理实践的探索。本文总体上是一项实证研究,其研究素材来自于监狱管理工作实践,所形成的研究成果可以为监狱工作者处理应对各类监管安全事件、提升监狱管理工作水平,加强应对处置机制建设提供一定的参考和借鉴。
[Abstract]:The security and stability of the prison is the basis of prison work, the precondition for the prison to punish and remould the prisoners, but also the primary responsibility of the prison administration and the construction of a socialist harmonious society in the new period. At present, the more and the outside conditions, the construction of hardware and software, the construction of the hardware and the hardware and the construction of the regulatory security facilities are the more important. Under the realistic conditions, the regulatory security events are still an important factor affecting and restricting the security and stability of the prison. From the perspective of the organization and management mechanism, this paper defines the coping mechanism of the prison supervision security events as the main body and elements of the prison system, and the relationship between the prison organization and the external environment. The process, procedure, and system of interaction and mutual coupling are designed to optimize the operation and control of the prison's own organization, realize the optimal allocation of various kinds of management resources, and achieve the best state of dealing with regulatory security events.
In this paper, on the basis of consulting and sorting out the relevant documents in Beijing prison system, this paper analyzes and abstracts it from the perspective of organization and management mechanism, and puts forward the prevention of regulatory security events, preparedness, and on the spot. The main ideas and suggestions for the establishment of mechanisms for post disaster recovery and reconstruction are as follows:
(1) the response of regulatory security events should be achieved from passive coping to active response, from result oriented to cause oriented development, the key is to adhere to the principle of prevention mainly, to strengthen the prevention of regulatory security events, to control unease through management and technical means, to eliminate the hidden dangers of accidents and to ensure the safety of prisons. The key points are to strengthen the organization and construction of different prison level prisons (prison areas), to strengthen the investigation work within the prison, to prevent all kinds of prohibited items into prison, and to strengthen the management and control of dangerous criminals.
(2) the supervision of safety incidents is to prevent and be well protected. In accordance with the danger of living in peace, it is necessary to prepare for all aspects of the solution, prepare to deal with the countermeasures and the corresponding human, financial and material resources before the occurrence of the event, and try to reduce the possible loss to the minimum. The key points of response preparation are contingency team preparation, contingency plan construction, emergency material preparation, and the ability of police force to deal with the improvement of supervision and safety incidents.
(3) the response and disposal of regulatory security events is the core link of the response mechanism. According to the nature of the event, the characteristics and the degree of harm, the relevant departments should be organized in time, to mobilize the emergency resources, to carry out the rapid and effective disposal of the regulatory security events, and to reduce the negative effects of the event loss and possible creation. The key to the disposal of the regulatory security events is the speed, The quick start of the reaction system, decisive command and timely coordination. In the treatment of the prison, prison should focus on dealing with the disposal links, disposing decisions and sending information on events, and so on.
(4) after the effective control of the regulatory security events, we should quickly change from the response to the disposal to the restoration and reconstruction, not only to restore the facilities and equipment that have been affected by the events, to normalize the order of the prison work, to summarize the experience and lessons of the events, to improve the ability to prevent and to improve the level of the prison management security events as a whole. In view of this, it is the most important task for the prison to strengthen investigation and assessment afterwards, to objectively and impartially investigate responsibilities and to strengthen the work of rehabilitation and reconstruction.
This paper analyzes and studies the response of the Beijing prison system to the security and stability of the prison system in recent years and carries out specific analysis and research under the background of the city's prison system. It is the basic and mechanism guarantee to fully realize the continuous security and stability of the prison system in Beijing by reducing the ability to solve the problems, contradictions and risks, and to minimize the frequency and damage degree of the regulatory security events.
The research on the coping mechanism of regulatory security events is an exploration of the practice of prison safety management. This paper is an empirical study on the whole. The research material comes from the practice of prison management. The results formed can deal with all kinds of regulatory security events for prison workers, improve the level of prison management, and strengthen the coping and disposal. It provides some reference and reference for the construction of the mechanism.
