中国语境下的“媒体审判”问题研究

【摘要】：新闻媒体的舆论监督在司法活动中发挥了越来越重要的作用,它在曝光司法腐败、遏制司法不公方面表现突出。但在舆论监督发挥积极作用的同时,新闻自由与司法独立的博弈中产生的消极影响也表现了出来,最突出的体现就是“媒体审判”问题。虽然学者们对“媒体审判”这一提法有着不同的见解,但媒体报道干预司法的现象确实存在,它所引发的舆论压力,对司法权威也有着一定的影响。但“媒体审判”可能存在的争议,并不能成为拒绝媒体监督司法的理由。如何扩大舆论监督的正面作用,消弭“媒体审判”的消极影响,才是我们研究这一问题的立意所在。 本文将从“媒体审判”研究综述;中、西方国家“媒体审判”现象的差异;我国“媒体审判”的发展及特点;媒体对司法报道过程的影响;“媒体审判”现象的成因、影响以及我国如何应对“媒体审判”六个方面,从现有研究成果入手,按照对比分析、现象分析、过程分析、成因分析,最后提出对策的逻辑步骤,对中国语境下的“媒体审判”问题做出系统的梳理和研究。
[Abstract]:The supervision of public opinion in the media has played an increasingly important role in judicial activities. It has shown outstanding performance in exposing judicial corruption and restraining judicial injustice. But while playing an active role in the supervision of public opinion, the negative impact of the game of freedom of the press and the independence of the judiciary also manifests itself, the most prominent embodiment is the media. Although scholars have different views on the formulation of "media trial", the phenomenon that media reports intervene in judicature does exist, and the pressure on public opinion has a certain influence on judicial authority. But the possible disputes in the "media trial" can not be the reason for refusing the media to supervise the judiciary. How to expand the positive role of public opinion supervision and eliminate the negative impact of "media trial" is the purpose of our study of this issue.
This paper will review the study of "media trial"; the differences in the phenomenon of "media trial" in western countries, the development and characteristics of "media trial" in China, the influence of media on the process of judicial reporting, the causes of the phenomenon of "media trial", and how to deal with the six aspects of the "media trial" in China, starting with the existing research results and according to the existing research results. According to the contrast analysis, the phenomenon analysis, the process analysis, the cause analysis, the logical steps of the countermeasures are put forward at last, and the "media trial" problem in the Chinese context is systematically combed and studied.
