【摘要】：1912年上海律师公会成立，在《律师暂行章程》的相关规定下，上海律师公会采用了会长制的运作模式，但是随着上海律师公会规模的扩大，，这种模式开始出现弊端。1927年在国民党政府的支持下，上海律师公会进行了改组，把原有的会长制改为委员制。在委员制的运作下，上海律师公会迎来了历史性的十年，在此期间上海律师公会蓬勃发展，对于上海的司法界甚至中国历史发展都产生过巨大的影响。本文试图通过研究1927—1937年上海律师公会的发展来了解当时的司法环境、律师执业和律师制度。文章的第一部分讲述了随着中国近代社会的变迁，律师制度的发展以及律师公会的初建，包括1912年至1927年上海律师公会在会长制运作下的发展，以及1927年上海律师公会委员制的改组过程。第二部分主要阐述自上海律师公会改组后的章程修改、律师公会会员的发展以及1927—1937年上海律师公会的具体运作内容。第三部分主要分析上海律师公会与律师之间的关系，包括上海律师公会对入会律师的认证以及对没有加入律师公会律师禁止出庭等相关的监督和管理、上海律师公会在维护律师地位声誉时所起的作用以及调解会员律师之间矛盾等等。第四部分主要就上海律师公会与法院之间的关系予以讨论，包括法院对上海律师公会的指导作用。律师公会也成为沟通律师与法院之间的桥梁，尤其体现为对实体法、程序法的解释，以及调解双方的矛盾。第五部分主要阐述上海律师公会对当时社会所起到的积极作用，包括对当时领事裁判权的收回，禁止设立租界律师公会以及抗日爱国运动等一系列历史事件上发挥了关键的作用。最后，对上海律师公会的职能特点，产生影响的原因以及当时存在的问题做总结。本文通过对相关资料的分析，了解上海律师公会职能的特殊性和影响的广泛性，从而加强对上海法制、民国律师制度的认识。
[Abstract]:The Shanghai Bar Association was established in 1912. Under the relevant provisions of the Provisional Charter for lawyers, the Shanghai Bar Association adopted the operation mode of the president system, but with the expansion of the scale of the Shanghai Bar Association, In 1927, with the support of the Kuomintang government, the Shanghai Bar Association reorganized and changed the chairman system to the committee system. Under the operation of the committee system, the Shanghai Bar Association ushered in a historic decade, during which the Shanghai Bar Association flourished and had a great impact on the development of Shanghai's judiciary and even the history of China. By studying the development of the Shanghai Bar Association from 1927 to 1937, this paper attempts to understand the judicial environment, the practice of lawyers and the system of lawyers at that time. The first part of the article describes the development of the lawyer system and the establishment of the Bar Association with the changes of modern Chinese society, including the development of the Shanghai Bar Association from 1912 to 1927 under the operation of the president system. And Shanghai Bar Association in 1927 the reorganization of the system. The second part mainly expounds the revision of the constitution after the reorganization of the Shanghai Bar Association, the development of the public members of the lawyers and the concrete operation contents of the Shanghai Bar Association from 1927 to 1937. The third part mainly analyzes the relationship between the Shanghai Bar Association and lawyers, including the relevant supervision and management of the Shanghai Bar Association's certification of admitted lawyers and the prohibition of lawyers from appearing in court without joining the Bar Association. The role of Shanghai Bar Association in maintaining the reputation of lawyers and mediating the conflicts among members and lawyers, etc. The fourth part mainly discusses the relationship between the Shanghai Bar Association and the court, including the guiding role of the court to the Shanghai Bar Association. The Bar Association also acts as a bridge between lawyers and courts, especially in the interpretation of substantive law, procedural law, and the mediation of contradictions between the parties. The fifth part mainly expounds the positive role that the Shanghai Bar Association played on the society at that time, including the withdrawal of the consular jurisdiction at that time. The ban on the establishment of the concession Bar Association and the anti-Japanese Patriotic Movement played a key role in a series of historical events. Finally, the paper summarizes the function characteristics of Shanghai Bar Association, the causes of its influence and the existing problems at that time. Based on the analysis of relevant materials, this paper tries to understand the particularity of the functions of the Shanghai Bar Association and the extensiveness of its influence, so as to strengthen the understanding of the Shanghai legal system and the lawyer system of the Republic of China.
