铁检改制后的设置及管辖问题研究

【摘要】：铁路检察体制改革是我国司法体制改革的重要组成部分。目前,铁路检察机关的属地化管理正在推进当中,纳入国家司法管理体系后,铁路检察机关在管理体制和工作机制上仍然存在诸多困境,诸如基层铁路检察院的属地管理与业务指导之间的协调与配合,铁路检察机关的管辖区域的划分,铁路公检法三机关的配合与制约等问题,都是铁路检察改制后无法回避的现实,如何认识这些困难及其成因,并为其寻求一条符合宪法精神的改革之路,已经成为进一步推进铁路检察工作的当务之急。
[Abstract]:Railway procuratorial system reform is an important part of judicial system reform in China. At present, the localized management of railway procuratorial organs is being promoted. After being incorporated into the national judicial management system, there are still many difficulties in the management system and working mechanism of the railway procuratorial organs. Such as the coordination and cooperation between the territorial management and operational guidance of the grass-roots railway procuratorates, the division of areas under the jurisdiction of the railway procuratorial organs, the coordination and restriction of the three organs of the railway procuratorate, It is an unavoidable reality after the reform of railway procuratorial system. How to recognize these difficulties and their causes and find a way to reform them in accordance with the spirit of the Constitution has become the urgent task of further advancing the railway procuratorial work.
